Can I still get a refund?
I bought a phone on ebay were the seller listed it as new, sealed, locked to ATT AND "NO IMEI guarantee".
That should have been my first red flag but I still went ahead. Before making the purchase I messaged the seller to guarantee me that the IMEI or phone wasn't blacklisted/blocked. We both checked on different websites and at the time it came up as clean. Once the phone got to me and I took it to the carrier to activate it it come up as blacklisted.
Now my question is, can I get a refund?

·3 years agoSo you bought a phone with no guarantee on the IMEI and you are opening a NAD and want a refund because the phone is exactly what you bought? Gotta love eBay….

OP3 years agoWell seller accepted the return on the 29th but has not given me the return shipping label and he has until the 3rd of August to do so if not then that's when I ask ebay to step in.

Under NO circumstances do you close the return before getting your refund, REGARDLESS of what the seller might tell you.

OP3 years agoWell today I escalated the case to ebay and as you all said they sided with me and are forcing the seller to send me the return shipping label so I can send the phone back and get my refund. He has 5 days to do so.

·3 years ago@luco_8039 just wondering what the seller's next play is? Seller sent a piece of junk that no one can use. Does not want to give up the money. Probably won't go down without a fight. Keep us informed.

OP3 years agoDon't know what the seller is waiting for but he hasn't send me a shipping label or responded to the case.

·3 years agoDon't worry if he does not respond. If the seller is outside of the USA, he can't send a return label. If the sellers date to send you a return label has passed, go back to the case and let ebay know that you have NOT received a return label and you should be refunded shortly.
For now, save the phone and the box and contents incase the seller wants it back. Do not toss it and do not use it in any manner. Once the case is closed, the only way for the seller to get it back is for him to send you money via paypal to return it to him.

OP3 years agoWell today was the last day, seller didn't send me the return shipping label, I contacted Ebay and they have refunded me my money back. I'm a happy bear.

·3 years agoIf it was within the 30 days of estimated date of delivery...need to check the date of the item when it was suppose to be delivered. I do realize if you live in Puerto Rico you should have plenty of time to return it.
I think eBay gives you a better time frame.
I bought a phone(s) through AT&T years ago and I could only buy another iPhone through AT&T Store and not through a Apple Store because my service is AT&T...even with cash. The server provider you have now you need to ask where to buy a phone. Heck, I live in San Francisco and you would think this is not an issue but it is.

·3 years agoLuco, buyers ALWAYS win item not as described cases if they follow the ebay prompts once they open a case.

·3 years agoIf you are within 30 days of the delivery date, open a return case.
Go to your eBay Purchase History and open a return case.
Find the item in your Purchase History and press the big, blue 'Return this item' button. Select "Item is Not as Described" as the reason for the return.
If it requires you to upload a photo to the return case you will need to do that.
Seller will be required to provide a prepaid shipping label IF they want the item back before refunding.
When the return tracking shows delivered back to the seller, the seller will have 2 days to inspect and refund your purchase. If that does not happen there will be an "Ask eBay to Step In", option for you to click on. EBay will refund your money.
If seller does not send a return label within 3 days and the "Ask eBay To Step In" option is not available, you may have to contact eBay. If you need help, come back here with details and dates of what has transpired. Or just contact eBay thru Facebook and tell them the seller has not sent a return label. https://www.facebook.com/eBayForBusiness/

OP3 years agoSo seller doesnt want to do the return because and I quote:
"Buyer bought the phone with no IMEI guarantee."
At the same time he also said and I quote:
"If you want a clean phone don’t buy a used phone that is clearly listed with no IMEI guarantee."
He says its used but on the listing he labeled it as "New".
Can that be used against him?

·3 years agoLuco, don't make things harder. Just open an item NOT as described case. Follow the prompts. Go back to the case in a few days. Have the phone and everything that came with it in a box and ready to be shipped back to the seller. DO NOT COMMUNICATE with the seller anymore. Do NOT close the case. Do NOT accept another item. Just don't talk to him. The system will get you a refund. Do as we tell you.
If you get a return shipping label after you open the case, print it, and ship out the box back to the seller. Make sure that you add the tracking # to the case. Once the item arrives, you should get your refund shortly afterwards. If no refund or no label, return to the case and ESCALATE IT.
Then if you want a new phone, go to a physical store and buy one there.

OP3 years agoI already opened the case and the quotes were part of his response to the case but I haven't responded back and won't. I'll wait for the moment I can ask ebay to step in. Thank you for the support, really appreciate it.

1. Whether the seller beats you to that moment to ask eBay to step in,
2. eBay automatically invites itself to ask eBay to step in, or
3. You get to it first, to ask eBay to step in.
But it's very important to ask eBay to step in before the deadline 21 business days from when the request started, or the case will automatically close without a refund.

·3 years agoWhy is it you always urge everyone to open NAD’s and chargebacks? The buyer received exactly what he bought? The item sold for significantly less than its value BECAUSE of the bad IMEI.

·3 years agoBecause it IS a INAD case. As per the OP, the phone was listed as new, and the seller shipped the buyer a used phone.
