I have all Marketing Communications turned off in eBay settings. I just received an unsolicted email from ebay telling me about Spider-Man funko pops. There is no information in this email on how to unsubscribe from it. I am receiving promotional eBay Messages by email even though General email promotions is disabled.
For a commercial marketing email sent to a U.S. email address, CAN-SPAM requires the message to contain a clear and conspicuous explanation of how to stop future marketing emails, plus an easy opt-out mechanism. It does not literally have to say “unsubscribe” or be at the very bottom, but the mechanism must be present in the email and understandable to an ordinary recipient.
“The Best Spidey Collectibles Are Here” is plainly promotional, and unmistakable a commercial advertisement. Being an eBay member does not eliminate my right to opt out of marketing messages. There is no unsubscribe link, “manage preferences” link, or reply-to-opt-out instruction anywhere in the external email. This email from eBay does not to comply with CAN-SPAM.
