Are you asking if you need to go to small claims court, or are you saying that you have gone to small claims court?
What did you purchase? When did you make the purchase? How much was the purchase? Was the seller in China?

·5 months agoYou had 30 days from the delivery date to open a Item Not as Described Return case thru your Purchase History on eBay.
Curious as to what exactly transpired with the transaction before you took it to court?

·5 months agoExactly how does one get their time back? If you spent an hour dealing with a bad eBay transaction, can the samll claims court judge wave his gavel and extend your life by 60 minutes?

·5 months agoYes, I believe that's a little-known feature of small claims court.
Am a shining example of that -- should have only lived to 62, but approaching 93.
Ask me how I did it. (Opening multiple small claims court cases, thus extending my life significantly with each.)
To the OP: You had 30 days after receipt to open an item not as described case with eBay. Were you perhaps unaware of that?

Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.
