AI driven VeRo reporting and rejected appeal when using backgrounfd elimination tool on the website
I've only use the background eliminator a few times and only on the main picture. On two out of maybe four uses I was struck with an intellectual property violation that was supposedly flagged by a user but decided upon by artificial intelligence. On both occasions, there was nothing in violation of the policies. On both occasions I appealed, showing that I had used my own photos and legally purchased authentic goods. Both times the appeals were rejected with ZERO explanation. I don't know if this is the correct place to address this complaint but it is technical issue if it is anything. I am willing to provide more information to get this resolved,

Sometimes sellers' own pictures are so similar to manufacturers' stock images that the company mistakes your picture as infringing on their intellectual property.
My method of mitigating that happening is to use the background cleaner for the first (main gallery) picture and insert the original (with the full background) for the second image. That way, it's easier to avoid the VeRO takedown and if it's removed in error, show them both pictures side by side to show that it's your own picture, just with the cleaned up background.

·8 months agoMost VeRo reports are for trademark infringement. Whether it was your photo or a stock photo would not affect whether you have infringed on a trademark.

OP8 months agohow could I infringe on it if I was representing myself as having affiliation or misrepresenting the product in any way? Like I said I think there is a correlation between the eliminator and the ai based judgement against me

·8 months agoWas the listing flagged during creation or after it was posted, and which brands were involved?

OP8 months agolistings can be flagged during creation? I've never had that happen. It was after the listing went live, maybe a day or two for both. The first brand was TV Ears, second was Xerox. I didn't use stock images, logos or anything to represent my store as being affiliated or anything.

And TV Ears has very strict Trademark Enforcement.

It’s probably best to sell these items somewhere else. If you try to relist them, they’ll likely be taken down again, and you could face an account restriction.

·8 months agoTypically, a VeRo item can be identified as "may be inauthentic" if offered new by an unauthorized seller. You will need to contact the VeRo member to get your listing reinstated. Most will ignore your message.

·8 months agoIt doesn't matter if a company is a VeRO member. You are allowed to resell items you own and obtained legally as long as such items are authentic.
The exception is if you have a contract with a company that disallowed you (as a representative of them) from listing on ebay. (I believe Mary Kay is such a company. Their MK sellers aren't allowed to transact business on ebay.) However if a third party purchases MK items from a dealer, they ARE allowed to resell them.

What does the VeRO takedown notice say about the violation? Can you copy and paste the text, redacting any personal identifying information?
Are they accusing you of unauthorized use of images?
Did you copy and paste any online specs belonging to them?
Is there mention of whether they being the item is counterfeit?

OP8 months agoYeah thats the weird thing: The TV Ears VeRo accused me of using a stolen stock photo. I took the photo in my photo booth and I shared a screenshot of my icloud history with the time stamped photo. The Xerox item just said intellectual property but I used the background eliminator for both. Both items were authentic and nothing was copied from any source.

OP8 months agoMy issue isnt that i was flagged, its that the AI decided my case against me with very overt evidence that I was not in any violation.
