How to lose easily your eBay Money Back Guarantee
Hi. I just by a new Xioami mobile by $750 as a christmas gift for my wife and I paid using Paypal (the have a money back guarantee as eBay). But the mobile was NOT deliver by FEDEX buy they report as deliver with no sign and no photo of the deliver....so it was stolen from my door (sorry, I have no video cam). Then I activate the money back guarantee from eBay and from paypal too, because the seller doesn't give me any answer different from FEDEX. I was really in shock by the time delays and need to take any action urgently to get a refund. Then I received an mail from eBay with the good news they accept my claim and decide to proceed with the refund, but 3 days later I received a new mail notify me with a new decision to cancel any action because I put a claim from paypal. So I canceled immediately my palypal claim reporting the ebay refund. But this action put me off the palypal money back warranty and I lost the ebay money back warranty too. So I lost my Xioami and lost my money and lost the credibility into both ebay/paypal money back warranty! So bad and so frustrating experience!!!

Your eBay case was doomed as soon as you opened one with PayPal. You can open a case with PayPal after losing a case with eBay ... but NOT while you have an open case with eBay. It makes you look like a cheater. eBay's and PayPal's money back guarantees require that you follow the instructions ... and you didn't.
If tracking showed the package was Delivered to your city ... then that is considered legal proof of delivery, and nobody is required to refund you.
What you MIGHT have had as a case is that eBay requires that items costing $750 or more MUST be shipped with 'Signature Confirmation'. That means even if tracking says the item was 'delivered' ... you could still win if you didn't sign for the package.
***** While you no longer have eBay or PayPal to file a case with ... you can try phoning your credit/debit card company and tell them the complete story. You'll be able to talk to a rep that wants to keep you as a customer ... so will have an easier time than filing a written dispute. BE SURE to mention eBay's requirement for Signature Confirmation on $750 items. I think that is your only defense now. Good luck!

·7 months agoEven if this is an old post the answer still good. I absolutely I trust getting my credit company involved always they don't **bleep** with them. I always get them involve in any money dispute. $750.00 is a lot of money, they came though for me all the time.
