Ebay Legal Division Information
I need the email, telephone number and physical address to ebay's Legal team. I'm filling out forms and I want to send them to the correct address. A valid email, telephone number and physical address. Also the same for the company President/ CEO. I don't know the title but whomever is ultimately in control of the Payouts for the company.
Ebay is STEALING MY MONEY. I AM sending the San Jose Police Fraudi Division to their Headquarters. They keep saying "out policy" and "nothing we can do about it" which their policy does NOT superceded California LAWs that protect consumers and there's. Always something that can be done. Withholding MY Earned money for a Week to "review" my account due to Unusually Good Sales. That's the Dumbest thing I've heard. Without Just Cause, it's ILLEGAL.
This is California. People sued McD for getting fat and Won. This is a Really Easy case .

I dont know where you are getting your 'legal' information from,but obviously, you need a new lawyer.

·2 years agoJust a tip - using ebay also means you agreed to binding arbitration outside of the court system in the user agreement. So, be sure to prepare for that as the CA judicial system unfortunately will not be of help to you.

Notwithstanding the parties' agreement to resolve all disputes through arbitration, either party may seek relief in a small claims court for disputes or claims within the scope of that court's jurisdiction and on an individual (non-class) basis only. If a party initiates an arbitration asserting a claim that falls within the jurisdiction of a small claims court, the other party may, in its discretion, require that the arbitration demand be withdrawn and that the claim be filed in small claims court.

·2 years agoAny police department will laugh at your claims. No lawyer in his right mind will assist you after taking a peek at the eBay User Agreement you are bound with since you listed your first item.
What is with the OP's low value items that are causing the extreme indigestion?
Is this just a case of the payment holds for new and infrequent sellers?

So many people replying get bent over very often I bet.
No. The agreement doesn't give ebay the rights to do just Anything. Not even close. There Must Be an action to cause alarm. To allow/ require the hold on funds to be necessary. A Due Process. A Remedy.
Everything still needs to fall within Reasonable Expectations.
And just because it's written and signed, Doesn't make it Legal. Example: If you agree, sign and stamp an agreement with your employer. That you are foregoing any Overtime Pay? Sign that as many times as you want. Dip it in gold. "I had 5 lawyers look at it", whatever. It's worth Nothing.
Unusual Sales. Sure. If I'm selling hair care products, making $13 a week. Then! I start selling large quantities of uncut diamonds... Yeah. Might put my funds on hold until the customer receives the order, possibly a few days more. But release the funds I Good Faith, call the FBI if you want, but it isn't grounds to withhold their money for an unknown amount of time.

Dream on. They can hold your money. You and your lawyer or 5 lawyers can't change their payment hold policy.
BTW some employees are exempt from overtime pay. Yes indeedy, they are. Quite a few.

OP2 years agoThis one's pretty hard for some people. I can smell a lot of Ridin' with Biden bumper stickers right now.
If I give something to someone for sale, them they sell it, I have an extremely reasonable Expectation to get paid immediately.I already played their 30 days game and I played along. Followed their made rules.
NOW. If there had been shhome signs of mischief or wrongdoing, then we talk. I have a 100% PERFECT score! Nowhere in their mtatement does it read if you do things right, they can keep your money as long as they want.

·2 years agoTake a deep breath - things will get better, if you let it happen. You were off to a good start selling, so don’t let emotions ruin a promising thing.
Most of us have experienced holds on funds - and all for good reason. Just give eBay the information that they have requested and wait it out.
eBay IS NOT a great place for new sellers to get money fast. So much can and does go wrong with new sellers - eBay knows that the return rate and INAD’s are much higher, so they need to hold back funds for the eventuality of refunds.
AND ebay must have a program in place to investigate unusual selling activity- far too much stolen property being sold on eBay.

Don't you remember reading the section about payment holds, that you agree to when you list here?

·2 years agoAll sellers go through payment holds at some time.
A new seller, selling a bunch of new items does throw up some red flags.
With all the shoplifting, stealing and robberies going on in Calli, they want to make sure everything is legit and you're not selling stolen property.
They'll probably ask for receipts for all the items you sold also.

I don't know if you actually have all the items on hand. I don't know if you are drop shipping.
It was probably not eBay. It could have been a company for a store that notice it.
Just my opinion and no one's else.

OP2 years agoWhat does that îhave to do with anything? I've Never heard of the Great Repeating Items Caper. People would typically continue to have access to the same supplies and goods.
I'm going through my stuff from storage and organizing so I continually find more. Plus after seeing some items sell for much higher, I put my personal supplies on list.

Ummm, you gave them permission to have access to your $.
When you signed the user agreement you agreed to abide by their policies.
Let us know how that lawsuit goes. Make sure your attorney reads the user agreement.
Ask them if you lose can they turn around and sue you for their attorney fees.

·2 years agoYes, it is your money. They are holding it up to 30 days, longer in some circumstances, not stealing it. Stealing means they took it without warning and you are not getting it back.
Whether you know it or not you did agree to all eBay's decisions when you joined. That includes all their polices. Payment holds can happen when you sell infrequently, when you list in a new category or if you sell expensive or high risk items.
I suggest you get over it or go somewhere else to sell if you don't like it.

OP2 years agoNowhere in the Agreement does it state that if you have 2 good sales then ebay can hold your fund, especially indefinitely.

·2 years agoAn easy case should need no assistance from other buyers and sellers that likely have no legal training for the most part. (that is what you get here, as here is just buyers and sellers)
Anyone with the expertise to go after eBay corporate should have the wherewithal to obtain the information needed. Seems google would provide such info.
Seems that eBay is allowed to do............................ what you agreed to.

I Never Agreed to those terms. I guess you read it as they can Hold for No Reason and as long as they want? And You signed it under that?

Go to Section 18
Whatever you do you will have to give eBay notice of your issue and allow them 30 days to address your issue. It could be that your money hold will be lifted during this time period or it could be that when you initiate an action it will extend the hold even longer.

·2 years agoWell, I do not know California law, or if it is even applicable, so really nothing in your initial post to respond to other than to suggest how to find the information that you are seeking.
I am confident that eBay will not hold my money for any reason that is not in the UA, so yes, "I signed in under that". I also singed to allow them to debit my checking account "at will" but am also confident that it will only be done per the rules/policies that I "agreed to".
