Ebay's reputation has suffered for many years due to the practices of Ebay sellers which are different from real retailers.

There are always Ebay sellers who want to offer "shelf pulls" items with expired dates or too short a date to be used before they will be expired. As usual, these sellers attempt to parse the Ebay policies to justify their action.

Pictures of the date code do not change the situation, nor does adding the info to the description.

The problem is that the term "expiry date" does not apply to food. I can't recall ever seeing a food product up here in Canada, at least, with the term "exp" on it the way there is for medication or similar products.

The terms used for food are along the lines of "best by" (or "best before" in Canada), "use by," or "sell by," with "best by" being a reference to the last date where the manufacturer is confident that the product has the quality it had when leaving the production line. Someone up here once said, "'Best by' does not mean 'awful after'." Up here, at least, it's up to the consumer to make a judgement call when purchasing a product past that date. Heck, we have an entire section of a store in my town devoted to selling discounted shelf-stable products that are close to or past the "best by" date.

Iâ€™m in Canada and I think our food safety laws are a bit different, so my thoughts may not be all that useful, but my understanding is that â€œexpiry datesâ€ only apply to medication and possibly infant formula. Food products have terms such as â€œuse byâ€ or â€œbest byâ€ and up here, at least, itâ€™s not against the law to sell food products past â€œbest byâ€ or â€œbest beforeâ€ dates as long as those dates arenâ€™t obscured or altered.

Can you find a link to that information, @wastingtime101? Maybe the articles I'm finding are, uh, dated, but I'm getting the impression that there are no federal regulations on date labelling for food. This is from a 2021 Consumer Reports article:

Sorry about that, @wastingtime101. I saw the "US" but not the "eBay" and my brain thought "federal" for some reason.

I'll probably stick with the info from Consumer Reports as CR does seem to be pretty good about keeping their information up to date.

I agree with those that have said that eBay needs to clarify their policy if they're referring to "best by," "use by," and "sell by" dates rather than "expiry dates."

I was under the impression that with drinks, (energy drinks, soda etc.)....you could list and sell them as "collectible" only if they are past the exp. date or best by date....but it had to be clearly stated as such in the item description....can anyone verify if this is true?

Sure, if you drain the expired contents and list the empty bottles/cans in the collectibles category, not the food category, and have both photos and text to verify the contents have been emptied.

You can't list full cans/bottles as "collectible" to skirt the exp date rules.

No, you can't list any expired food items.

Sellers have tried that and the listings were removed,

No, the best by date isn't an actual expiration date, but they are treated the same.

Since Ebay removed the listings, I guess you know their stance on it.

I do not know their stance on it because my listings being removed could have been done in error. That is why there is an appeal option when this happens. eBay's stance on something is their policy and I don't see anything in their policy about a best by date.

They are pretty much the same thing.
