The second time the UPS driver deliver to me, a white dirty envelope, instead of the cell phone that I ordered. I said to the UPS driver, what the hell is this, I ordered a cellphone and you brought to me a white dirty envelope. Ebay had refund me, but I was temted to take it to the Police station, to enshure that things like this dont hanpen to some one else. I am asking that ebay investigate this matter, that it dose not happen again

Please do not waste taxpayer dollars by getting local law enforcement involved in an eBay transaction. eBay transactions are civil matters for the most part, and eBay has policies in place to make you whole if you follow their steps. If you were going to involve criminal investigators, it would be with the carrier's fraud department. Whether you can do that depends on some clarification from you.
Are you saying that eBay has already refunded you and you are not owed any money? A simple yes or no will suffice.
Maybe we need to step back and ask what do you mean something you didn't order? If you did order something, how do you know it isn't what you ordered?
Once you open the package, you can't just reseal and give back to the driver. Never have been able to do that unless a return label was included in the package. The only time return shipping is covered by original postage paid, is if the package was marked return to sender unopened or something that could not be delivered/refused. Otherwise cost to send it back and has to be paid by someone, not as described would be the shipper. As said you need to open the case suggested above.
Refusal of delivery will void ebay's money back guarantee.
What you need to do is open a case, with the reason ITEM NOT AS DESCRIBED. The seller will pay for you to return the wrong item, or issue you a refund and let you keep it, at their discretion. (If they don't, ebay will step in and refund you.)
If you refuse the package, you lose your MBG and the seller wouldn't have to refund.
Accept the package and go to your purchase history and click return item and select, the item doesn't match the description as the reason. The seller will have 3 days to accept the return and pay return shipping or refund without returning. If they don't, return to the case on day 4 and ask Ebay to step in.
