Damage to my lawn

Hello. Got a delivery today. Delivery person thought it was a good idea to drive around my house. (Western Massachusetts ) Ground is wet and mushy. Large tracks in my yard. Wished the person used the driveway. Did a lot of damage to my lawn. Any suggestions? Can’t find a live person that will handle this.

You need to contact the local facility of the courier ASAP. They have insurance for just such an occurence.

That would be tough since buyers are the ones who actually select the shipping carrier. Even if the seller offers “Standard Shipping,” so there is no specific carrier for the buyer to choose, or even if the seller selected a different carrier than what the buyer chose, it would be summarily dismissed. Once a seller hands a package over to the carrier, the carrier assumes legal responsibility. If the OP attempted to sue the seller, they would be summarily dismissed as a defendant.

Now, if a seller fails to declare something is HazMat, there could be an arguement to be made. More than likely, however, a trial attorney would not waste time and money suing the seller unless they had business insurance and could be hit up for a quick settlement. Instead, they would sue the carrier who then would have grounds to sue the seller. .

@idwk3754 Your issue is with the carrier. They are the ones responsible. Be sure you promptly take photographs of how your proprety looks.

Well, maybe you can put together a case where your seller is responsible because their agent damaged your lawn. You sue the seller, then he is free to sue the delivery agent. But, seems like you’ll be going through more work and expense then you can reasonably expect to get out of your small claims lawsuit.

I really don’t know – maybe there is something in the eBay terms of service that would address liability limits for sellers.

As others have noted, ebay has ZERO liability here. You need to take this up with whomever was the shipping carrier. Ebay has no influence over the people hired by UPS, FedX, DHL, etc. to act as delivery drivers.

Anything happening after the item is in transit, from acts of God to porch piracy, is well beyond ebay's control or liability.

You may be unaware that eBay does not provide an independent delivery service.

If you have a delivery issue, you will need to take it up directly with the company that made the delivery.

Surely you don't think ebay is going to compensate you for this?

You need to reach out to the delivery company. If there's significant damage, perhaps you'll be taking them to small claims court.

That is not something ebay will be helping you with unfortunately. You'll need to go to your county courthouse.
