Seller is a theif and the current Acuna PSA 10 he is trying to sell ( exact serial number ) was purchased by me and he will not ship it to me and he is trying to sell it again. I have to wait until April 30th to file a claim against him for my order not arriving.

Not completing the sale does not make him a thief. You sell cards yourself so it seems like you would know this.

Looks like he wants $89 and not $33. Not anything you can do to make him honor the sell. You could report him for cancelling the sale.
