Wrong item - open case
Buying - I received the wrong item - totally wrong (inversion table instead of Lego set) - messaged seller - no response after a half a day - opened a wrong item case - seller messages to keep wrong item and he will send Lego set. But to please close the case. If I close the case but never receive the promised item can I open Item not received case?

·10 months agoIf you close the case, you lose all buyer protection.
DO NOT close the case unless you 1) receive the correct item, or 2) receive a full refund.

·10 months agoNO NO NO ! Do not close the case. You can't reopen it if you do. You can but don't have to advise the seller the case will close the moment they issue a full refund. Once closed you can't do any more with that case, you in effect told eBay your happy and done with it.
The seller will have to refund in full. If they don't you can ask eBay to do it for them after 3 days if they still have not.

This sounds to me like a drop shipper. Did the Inversion Table come from a warehouse like AMZ or WALMART?

I do not like disagreeing with my first few colleagues who replied but, It seems to me like your seller is willing to send your item and let you keep the inversion table. Their request to close the dispute, may come from inexperience at selling on ebay, not as an attempt to scam you. We could tell you more definitively if you posted the ebay item number here so we could check out the seller. You can find the item number just under the item title in your Order details.
The reply by @house*of*paws , may be right, they do not want to pay the return shipping. What they should do is send your item, sending you a tracking number. When you receive it, then you can close the case/dispute and it will not count against them. FYI, a half of a day without response to a message, is not unusual on ebay.
If you message the seller again and tell them you will close the case after they either send the item you ordered adding a tracking number to a reply, and you receive it, or if they issue a refund. Then it will not count against them, since they complied with ebay's return policy and then you close the dispute. They may respond to that. An item not as described, or wrong item received, dispute stays open for 30 days, unless closed, so they have time to correct the situation. Once you close it ebay considers the issue resolved.
If you get to keep the inversion table, either list it on marketplace or another site. Or donate it to a charity who will pick it up.

·10 months agoUnfortunately saying & actually doing are not always the same thing.
Since eBay will not permit the buyer to reopen a NAD request once closed, & will not protect the buyer should the correct item fail subsequently to be shipped , or not be as described.
Why would the buyer elect to volunteer to take all the risk, when eBay could simply elect to either modify or change it's current policy or allow a policy exception to protect this ebay buyer ?
It also appears that there is no contributory negligence by the buyer & eBay needs paying buyers

DO NOT CLOSE THE CASE. The seller will be under no obligation to send the Lego set if you do that.

·10 months agoDon't close the case. You will lose an Item Not Received case as tracking shows something was delivered.
I believe Received wrong Item is considered the same as Item Not As Described. Wait for the seller to send you a return label. If they don't after 3 days ask eBay to step in.
If they send you a return label send it back.
Either way you will get a refund.
The seller looks to be trying to get out of refunding you. If it were me I'd stop communication and let the automated return process take it from here....................

Tell the seller that you will ONLY accept a refund at this time … and that you will ask eBay to step in if you don’t receive notification of the refund within 3 business days of opening the return request.

OP10 months agoThank you. I have asked for a refund. I hope I don't have to take the wrong item somewhere to be shipped back because it is very heavy and I can't lift it. It is something I really don't want and is putting me out just to deal with it so it is no plus to keep it (in fact its an annoyance) and worse to have to send it back unless someone will come pick it up. This has been one of the worst ebay transactions I have had if not the worst.

If the item is heavy ... then the seller probably doesn't want to pay the shipping cost to have it returned.
If you don't hear from the seller within 3 business days of opening the return request ... THEN go back to your open request on Day 4 and ask eBay to step in. eBay will do the rest.
[Should you be sent a return shipping label ... it likely will be a USPS Priority Mail label, which means you can phone your local post office to pick up the item from your home.]
