Would this situation count as item not as described?
I bought an item listed as m/l in the title, but medium in the item specifics. There was a pic of the brand tag but no size tag. There were no other measurements. I was replacing an item I own that is 10 years old and I know the exact one I own is a medium so I didn't think it would be a problem. It is the exact same item that I own.
When I received it, there was a size tag and it was large. It is huge on me. I tried to see if it would work but it's just too big. I contacted the seller to let them know there was an error in the listing and hoped we could figure out a return. I paid $28 total for the item, and absolutely cannot use it. Had it been a medium, I'd be very happy a couple year search would be finally completed.
The seller ends up sending a refund for $5.40 instead with a message "sorry'. Well wait, thanks? But I still can't use this and I felt like it was misrepresented and now, is a return even accessible? Now my loss is $ 22, and that's not as bad, but I still can't use this, so I would end up donating it. And that makes me feel like I'm donating to the seller who didn't have a clear listing. It did say m/l in the title.
Would it be wrong to return for item not as described? Sigh... this makes me so angry. I want ALL my money back and I don't want to be stuck with this item I can't use.

·9 months agoHi, Agreed with all. File an item not as described case & get your $$$$ back. We here in New Jersey dont' really know what your seller was thinking by just "throwing you a partial." It seems a bit silly. Good Luck! Come back with any further issues. There are some great & very knowledgeable folks here who are always willing to help.

·9 months agoGiven there was a tag that clearly said large, then I agree with the others that this falls under INAD.
I'm going to defend the seller for a moment. I believe you likely got a partial refund because you were not direct about what you wanted. You left the door open as to what would be an acceptable solution by saying you "hoped we could figure out a return." I realize what you meant was, "I want to return this." However, that type of non-direct language you used often comes from people who are seeking partial refunds. Those type of people especially like to use the phrase "figure out." That's not your fault, but I understand how the seller may have taken that. I'm assuming the seller has a "no returns" policy, and that by its nature comes with more partial refund scammers. By stating that you "hoped" you all could figure it out, it sent the message that you were open to a partial refund. I can't find fault with the seller for sending you one. A lot of "no return" sellers would have ignored you.
I would write the seller again and say, "Thank you so much for the partial refund and trying to make this right. I did not communicate clearly to you in my original message. I would actually like to refund this for a full refund because the sizing was not correct in your listing and I cannot use it since it isn't a size medium. Would you like me to go ahead an open a return for the item not being described accurately?"
At that point they will likely send you the rest of your money and tell you to keep it.

·9 months agoThis item was Not As Described.
M/L is not the same as Large.
Medium is not the same as Large.
Size tag says Large.
On a side note: I'd only buy clothing with the measurements shown. Even the exact same shirt from the exact same brand can have different measurements if they were made in different factories.

Yes you can file an item not as described dispute but do not use the reason "does not fit". Select Does not match description or photos. Does not fit when a size is given in a listing, makes the return a buyer's remorse one, so you would have to pay the return shipping cost.
Before filing the dispute read the terms and time frames of ebay's Money Back Guarantee by opening the link below.
https://www.ebay.com/help/policies/ebay-money-back-guarantee-policy/ebay-money-back-guarantee-policy?id=4210
In the future, if there is conflicting or incomplete info in a listing ask the seller about it before buying. If their response doesn't help or they do not answer, then do not buy from them.

·9 months agoYou can file an "item not described" claim and return within 30 days. If you are not satisfied then yes your complaint falls under the "item not described." Return the item. The seller should've advised you to return the item for a refund instead of giving you a partial refund.
