What happened to buy with confidence? If an item is not what it appeared to be I expected to return
The bowls arrived and were very tiny. In appearance they looked the same as the ones I owned already, but were only 3 1/2†across across. The bowls I owned are 5†across. I was not allowed to return the small bowls.
What has happened to the guarantee of buy with confidence?

·8 months agoThe seller didn't list the measurements, but, it might come down to what reason you used in the return request.
If you used not as described Ebay automatically gives you a return label, if you used didn't fit, didn't like, ordered by mistake, ordered wrong item, or something similar the seller can refuse the return.
We accept any return for any reason, but if it's for one of those reasons above, the buyer has to pay for returning it..

·8 months agoIn practice, Ebay usually honors all requests for return with the reason Item Not As Described.
How did you request a return? The proper procedure under the MBG is NOT sending a message to the seller.

·8 months agoShame on you @tobaccocardyahoo for suggesting that the buyer file a false MBG claim for something that's clearly remorse.

Shame on you for excusing an unprofessional seller.
A seller who fails to provide critical information has failed to describe the item.
When items are covered by Ebay authentication, the authenticators notify the buyers of all significant omissions by the seller because failing to provide sufficient information is a violation of policy. The buyer need not ask for critical information about the offering.
This is a seller faulted issue. I voluntarily process a return if I failed to provide adequate information, and have encountered other sellers who have similarly behaved.
You and any other seller can parse Ebay policy in any way you like, but Ebay will accept the INAD as valid, and some of us will agree with them. Errors of omission are errors.

You should have asked about the measurements.
It is not the seller's fault that you were unaware about anything about these dishes.
You should know that you cannot tell from a photo how big or how small anything is. A pattern may be identical but if you see a photo of a bowl or a plate, there is no way to know what size it is.

NOTHING happened to it.
It is right there, alive and well.

OP8 months agoThanks! But it appears that it is not honored when the item is not what I expected.

·8 months agoFor items that are CLEARLY marked as 'No Returns', yes 'remorse' (latin for ignorance as well as sellers and this site is NOT a mind reader) can be 'denied'.
Thankfully.
Chalk this up as a learning lesson that you need to verify 'measurements' if not shown, no returns, and it matters to you.

·8 months agoThe money back guarantee states:
"Sellers are required to deliver the item as it was described in the listing. If the buyer receives the wrong item, or the item arrives broken, damaged, or faulty (and was not clearly described as such), they are entitled to return it for a refund, even if the seller doesn't offer returns."
So no, it does not apply to what you "expected". It applies to what was shown/ described in the listing. Since no measurements were shown, there was nothing false about the listing.

What was the item number of the listing?

·8 months agoThank you for that information.
Respectfully, this error is on you. If the size was important, you should have asked questions.
The item isn't "not as described" so any return would be for remorse. And sellers with "no return" policies aren't obligated to accept remorse returns.

It's still there in full force but it is up to the buyer to do some due diligence before buying and ask questions about anything not stated or shown. Did the seller state the size of the bowls in the listing? Did you know the bowls came in sizes other than the ones you already own?
If the size of the bowls was stated in the listing, the mistake is on you and the seller is not required to accept a return of them.

Were the dimensions of the bowls specified in the listing? If so, they don't qualify as an item not as described return, and the seller's return policy will apply. EBay has never guaranteed that you can return something just because you don't like it or failed to fully read the listing. What they do guarantee is that you can return an item for a refund if it's not what was described in the listing.

·8 months agoThanks for providing more info.
In this case, the seller did nothing wrong. If there were no measurements given, the onus is on YOU to make sure, especially if the seller has a NO RETURN policy. Most sellers are small sellers and can't afford to constantly be taking returns because a buyer either:
1) Did not read the listing
2) Did not ask questions prior to purchase
It is NOT the seller's responsibility to educate you on whether or not the dishes came in different sizes.
Perhaps you can try to resell the dishes, but in this case, the seller did NOTHING wrong. This is on you.
Live and learn.

·8 months agoNot enough information here. If your purchase was not as described, you have 30 days after delivery to open an item not as described case per the Money Back Guarantee.
Have you read the MBG?
