Advert for sounds oh so cosy. We are a small business..in beautiful North Wales very near the seaside. Don’t be fooled the owners have no scruples whatsoever. I bought some Clogau earring £125.95 in the summer to keep for my wife’s Christmas present . She opened present on Christmas Day. One of the earrings was damaged and the fastening was damaged. I emailed sellers and suggested they either repair or refund me the money. They immediately contacted ebay who off course stipulated no recourse after 30 days. That’s not the point, sent me damaged goods. Morally they should refund/repair. But as owners have no scruples they came up with all sorts that of excuses, damage in post (my father was an ex postman was one excuse). I’m trying to send a different pair of earrings. I should have checked the earring, how in earth should I do that they’d in a box and look fine. The owners didn’t even apologise for my wife having a damaged Christmas present ! Zig Nowicki

Your only recourse will be through your credit card. Paypal also only allows 30 days to open an item not as described case.
Like all other businesses eBay can't set rules for morality. I know it won't help this time, but hopefully you've learned the lesson to check gifts when they arrive, not when the recipient opens them.

Ebay has a very generous money back guarantee policy but you MUST open your claim within 30 days of receipt.
Had you opened the item, verified the condition and filed a claim within the 30 day timeframe, you could have returned them for a full refund.

Your only recourse may be thru your credit card issuer if you paid that way or perhaps PayPal if you used them.
File A Item Not As Described dispute or Arrived Damaged.
Perhaps there are other options for you in the UK. You posted on the ebay.com boards.
Here is a link to the UK boards if you want to bring it up there.
