UPS package says received, but was not.

I ordered an item last week that says it was delivered via UPS to me, but was not. I thought it was odd that the package never showed up in my "MyUPS" app, which is very good at knowing when something is coming to me. The tracking details show it was signed for by someone, and it gives a last name, but its not mine. The seller will only respond to me with 1-word messages saying "delivered.". UPS confirmed to me that the name and address on the package was not mine, but for privacy reasons would not provide me details. Clearly, I got scammed, but eBay doesn't see it that way. I am trying now to gather info as much as I can. If my appeal fails, will I get another chance, or is it only 1 appeal? Thanks!

The customer service rep is right, Federal regulations do not allow them to disclose a shipping label's destination or the package type/size/weight. A UPS rep might send you an email saying the item was not addressed to you, but ebay will not accept an email, since those can be faked.
What you can try to do is take a copy of the email to a UPS store along with a copy of the order details and if you still have it the UPS My Choice email showing no deliveries on the supposed delivery date. (if you use a phone or tablet) bring it along to show the clerk that info.
Once they've seen that ask them if they will write a note on UPS stationary, saying in general that the address provided in the Order details (yours) is not the same as the one on the tracking number's label, and if applicable that the package type/size/weight is not correct for what you should have received. Without stating the label address or package info. If you get a note you can attach a scan or clear photo of it to an ebay Appeal.
If they will not write a note there is no sense in appealing through ebay.
If a clerk will not write you a note, and you paid with a credit card, contact your card provider, using the number on the back of your card. Tell the rep you have been the victim of a fake tracking scam mention if you get an email from UPS customer service, ask if there is a way to forward that and your UPS My Choice email for the date the item was supposed to have been delivered, to them as proof that you did not receive the item? Your card provider will investigate and you may get a refund from them.
Your other option is to file a new Return dispute through ebay for Item Not As Described > Doesn't match photos or description. The seller will have 3 days to reply by sending you a return shipping label, or a refund without having to return the item. If they do not do one of those two things. On day 4 go to your My ebay page click on e Return and click on the Ask ebay to step in button. If they send a label slap it on a manilla envelope with stiffener or a circular ad in it, and send it back.

Luckily, eBay was able to provide me a refund based on the fact that the tracking page said it was received by someone (it listed the residence name in the proof of delivery section of the tracking) who does not live here. I had also sent a confirmed delivery page with my name in the proof of delivery for comparison.
