Tax refund
Bought a few times some gold (gold bars) from Ebay seller - company. Ebay added a tax to that transaction. I asked them what reason they have to add that tax. A mistake they said, gold does not have tax, money will be refunded.
One year later, after several discussions: We will refund. When? Sometime in the future...we cannot give you a timeframe for that.
In the meantime, i bought some more -same gold bar- from same seller. No more tax.
But also, no refund.
Anybody has idea what`s going on?

·1 year agoLOL, ebay won't refund a sales tax overpayment. Your recourse is to request it from your state sales tax office. If your purchase should not have had tax collected, and you submit evidence of that, they will refund you.

OP1 year agoI can see a lot of contradictions in the above statements.
EBAY statement (three separate discussions-answers) was: You don`t have to pay tax (I'm not US citizen).
I guess some people are not fully reading my post: I bought again, same amount, same seller, same delivery address and was no tax added anymore by Ebay. Still, they did not refund money from previous transactions.

All those parameters could be the same, but it is irrelevant without knowing the CATEGORY the previous sale was in.

Once Tax is collected, ebay (in most cases) does not have the ability or jurisdiction to refund collected SALES TAX.
You are not a U.S. Citizen? How did you get charged Sales Tax?

OP1 year agoAgain, Ebay made it very clear that it was a mistake and money will be refunded.
Product was listed in the same category-and they sell the same stuff for the last 10 years, shipped and delivered in the same way, to the same US address, to the same person. 3 times they added tax, after i contact them, no more tax.
Consider the case closed. I really do not need this Facebook-kind of discussion.

tax would be based upon where delivered. Matters not if you are, or are not a U.S. citizen.
Also, some Freight Forwarder (if that is what you are using) Zip codes were changed to "tax exempt". May or may not be the reason for tax before, and not now.

Some states charge sales tax on gold bullion and others don't.
Also, whether an item is taxable or not can depend on the value of the purchase. For example, in Massachusetts, gold bullion valued at <$1000 is taxable but if it's valued at $1000 or more, it's exempt.
You need to check on the taxability in your state.

·1 year agoYes, go to your state. If a seller collects the tax, right or wrong, they are required to forward it to the state they collected it for. Not sure on a time frame, but if a recent transaction (maybe before a filing period) the seller is asked to make an attempt to refund, if they cant, they still must forward the money to the state/jurisdiction. That state or jurisdiction is now where you must head to get the refund, because they are the ones who have your money

Sellers don’t collect sales tax, eBay does and remits the tax to the buyers state.

·1 year agoThat I know..I meant sellers as merchants in general who do collect tax..if they collect it, they must send it, even if collected erroneously

·1 year agoeBay collects the tax not the seller and eBay is the ones that send it to the taxing state, not the seller so what a merchant does in a B&M store is moot. Besides what was posted above, if it is posted in the wrong category, it can still be taxed.

·1 year agoYou have to file with your states tax office. Don't know if it's too late. You will have to call them to see what forms you need. They can often be found and printed on line. You need a copy of the eBay sale showing tax was collected to attach.
