eBay isn’t likely to change things based on buyers complaints.
Contact the State tax office to let them know of the discrepancy. If they determine there is an error, they will contact eBay and eBay will be forced to quickly comply.
As already pointed out, collectibles will be taxed.

·6 months agoAh yes, yet another user who failed to read the User Agreement their continued use of the site obligates them to. In regards to legal actions it says this [the bolding is theirs]:
"You and eBay each agree that any and all disputes or claims between you and eBay (or any related third parties) that arise out of or relate in any way to this or previous versions of the User Agreement, your use of or access to our Services, the actions of eBay or its agents, or any products or services sold, offered, or purchased through our Services, including the scope or applicability of this Agreement to Arbitrate (each, a "Dispute") shall be resolved exclusively through final and binding arbitration, rather than in court."

OP6 months agoeBay is violating State law and most likely not passing this collection on to States or the IRS.

·6 months agoIf you have no evidence that eBay isn't passing collected tax to the states (I assume you're unfamiliar with the audit processes every marketplace facilitator undergoes) then you're just flapping your gums. And what funds would eBay ever pass to the IRS?? 😅😂

OP6 months agoI’m living for the resolution wherever it occurs. They’re blocking transactions with an illegal tax on money. They’re not supposed to be in the way of business being conducted, they’re supposed to be a platform where it can be conducted.

If the bullion you bought was in the form of a commemorative ingot or coin, and it was listed in the Collectibles category, not Coins and Paper money then your state is likely taxing it. Open the listing you bought from and look in the Item specifics box in the lower right to see what category it was listed in. Collectibles are taxed.

OP6 months agoBoullion -silver - coins category is on the most recent purchase. And the levying of this bogus charge is inconsistent. The seller isn’t changing their listing categories - money - but eBay seems to be levying the undue tax 4 out of 10 purchases with this seller. I’ll go back and check categories as you suggest on the other robberies, too. But I think this is intentional by eBay, not error.

Those are some bold claims. You’re making an assertion that eBay is violating multiple laws and stealing money marked as taxes.
It’s not just bold, though, it’s ridiculous. eBay is not some fly-by-night operation that could go unnoticed by multiple taxing authorities if they tried to pull something illegal like that, and I guarantee they’ve had many lawyers and financial professionals look over their procedures to make sure what they’re doing is not illegal. They also don’t keep anything that says it’s a tax, that gets passed along to whatever tax agency it’s designated for, and if it shouldn’t have been charged because the seller made a mistake, the buyer can request it back from that tax agency (which wouldn’t happen if eBay wasn’t sending it along as stated).

THAT is 'tax collectable' per MOST states. PERIOD!
Go complain to your seller.

OP6 months agoThe conduct is harming both the seller and the buyer and benefits only eBay. There has to be a way to correct this and eBay isn’t trying to because the profits from buyers being unaware this tax is illegal probably far outweighs the 12 of us saying no.

·6 months agoNo. There are at least 3000 'exceptions' in the Sales Tax Code for Pennsylvania alone.
Imagine how many 10's of THOUSANDS there are for all the other states.
I believe that 3rd party marketplaces are simply allowed to 'tax all' and it's up to the buyers to cry to their own states for their money back (there's a place on your state income tax filing...use it!)
