Should "As-is" be allowed to be used as get out of jail free card?
I bought a electronic item, under the Condition, it says used, dusty.
In the description the seller wrote "This is a fully functional (whatever item)...." and end with "As Is/No return"
As a buyer I'm thinking, ok, the unit works, but not in 100% condition, such as scratches, ding, dust, and seller does not want return due to those excuses.
Now I tested, the power led just blink, the unit does not work, what is the best course of approach? On one hand it is "as is", on the other hand it was described as functional.

OP1 year agoThanks for everyone's advices, I am working with seller to troubleshoot the issue, seller did offer refund, but I prefer the unit working, so we are resolving this right now.

·1 year agoOnce upon a time on .uk you couldn't return items that were listed for "Parts or Repair" but changes in distance selling laws overrode that.
Maybe .com had a similar short period where the seller could sell something as broken and not get a return because it's broken.

·1 year agoSure "as is". In this case "as is" meant it was fully functional so you did not receive the item "as is". You received it in another condition. Return for refund.

I pretty much agree with the others about not working as being at odds with the description saying "Functional". However, I would first search online for a user manual for the item, Then look through it to see what the blinking LED light means. For some items a blinking light indicates the item is waiting to warm up, receive input or other things before it starts to function. Then again in other cases it can indicate that there is a fault. I would try to find out what the blinking light means, before filing a Return for not as described.

(Even if it said for parts only it can be returned) In this venue, the buyer is always right.

You are BOTH correct.
It should have been listed as "for parts" but that still doesn't protect entirely against a NAD return.
As undoubtedly you are both aware.

·1 year agoMaybe it depends on the reasoning they open the case, but I have sold many parts that I have listed condition as "For Parts or Repair", along with putting it in all caps in the listing. Most people seem to read the description and understand this.
However, I have won multiple cases, and had negative feedback removed, when it was clearly stated in both the condition section and in the listing description itself.
Seeing as people file INAD cases just to get a return regardless of actual reason or issue, nothing you do can prevent that unfortunately, so I get what you mean on that side.

Used is fully functional.
Return as Item Not as Described. Open a return.
