Shoes sent wrong size!!!
Ebay Community please help....
I ordered a very expensive, designer shoe (~$1,000 retail cost, my costs ~$400, used) and the seller sent a 42.5. The post is very clearly for a 43. They don't fit. I'm a true 43, if not 43.5. Normally designer leather shoes stretch a little. I cannot wear a 42.5.
I opened a return and sent Ebay a photo showing these are 42.5. The seller does not accept returns, but I am covered by Ebay Money Back Guarantee. The item is not what the post described.
The seller responded "no returns." My case is stating closed and unable to appeal. This cannot be possible for a shoe that was sent in the wrong size. I cannot get anyone on the phone. What can I do?

I noticed that nobody 'tagged' you ... so I wanted to make sure you read the excellent replies you were given.
Because of the infuriating 'Doesn't fit' issue ... you have exhausted your ability to receive a refund from eBay. I would stop trying and go immediately to your credit card company and request a chargeback. Good luck~

OP2 years agoSpeaking now with someone on the phone they are deeming my case to have been "change of mind" due to me stating the shoe doesn't fit. I described that it doesn't fit because the wrong size was sent. Item not sent as described. The subject title to my return request was "doesn't fit". The body explains why. Then I attached a photo of the tongue of the shoe showing a 42.5 was delivered to me.
Ebay apparently didn't open my email, or investigate. They didn't look at the photo. They simply saw "doesn't fit" then through me into a box of "change of heart" then looked at the return policy for this item which seller wasn't accepting returns.
Who can I speak with to utilize my Money Back Guarantee Ebay so supportively offers? I am eligible given I received an item not as desribed.

·2 years agoAll Money Back Guarantee cases are initially decided by bots. So there was no human interaction to open an email or look at a photo. The bot saw 'doesn't fit' and automatically classified it as a remorse return. I totally agree you should have been eligible for a refund. However, it's going to be much simpler to just dispute the charge through Paypal or your credit card than to try to get eBay to change their decision.

Notice the difference between NAD and remorse:
NOT AS DESCRIBED: The listing was described as being 43 but that's not what you received. You received 42.5. So that's NAD. (True they "don't fit" but that's not because of remorse but because they aren't the size listed and described.)
REMORSE: If listing described 43 and you received 43 but they didn't fit, then that would be considered remorse. They ARE as described.
In a remorse return request, seller who doesn't accept returns can deny the return.

·2 years agoI suspect that the issue is that you chose 'doesn't fit' as the reason for the return rather than 'not as described'. Ebay considers 'doesn't fit' to be a remorse return, so they won't force the seller to accept the return. It's part of the Money Back Guarantee that's honestly confusing and trips up a fair number of people.
EBay won't allow you to modify your case. So at this point you need to open a case with Paypal, if that's how you paid, or dispute the charge with your credit card.

·2 years agoIf you chose "Item does not fit" which is a remorse reason for the return, the seller can deny the return.
If you had chose "Item Not As Described", the seller would have had to accept the return and provide a prepaid return label.
You only get one shot at choosing a return reason.
Your next move is with your credit card issuer or PayPal if you paid thru them. Item is Not as Described is the reason for the chargeback.
