Seller will not send item I purchased.
I purchased a tea set from a buyer who started the bidding at 99 cents. No one else bidded on item. Now seller will not send item. I have sent a number of messages and they will not respond. I have contact Ebay several times concerning this matter. I explained I DID NOT WANT A REFUND! I want what I bought and paid for. So what did they do, sending me a refund and nothing is happening to the seller. They get off ripping me off. Not fair. Getting so tired of this.
I sold an item (I stated selling in USA only, but they send it out to England) So I get an offer to buy and they knew the shipping would cost an arm and a leg. They agreed. Then I get messages from them 3 days after I mail it and insured it too. They start making threats that I over charged them on shipping, nope charge just what I paid even sent copies from post office. Then they tell me how they will be so upset if item came damaged. Gee only 3 days after I sent it and they start making threats that it had better not come damaged. Well, you guessed it. After they get it they claim it was damaged. Claimed I didn't pack it well. Funny it was in box from manufacture and I used all the packageing they had it in. I had moved clear across the USA twice and it never broke. Asked to see packing boxes. NO DAMAGE to outter box or inner box nor any of the peanuts I had it packed with. Was able to see a few chips on this statue that could not have happened in shipping, only if item fell or was knocked off something. So I HAVE to refund all money, I have to eat the cost of shipping, the cost of item and packaging, just so someone can replace a item they broke with a new item. I didn't even get the broken one back. I showed Ebay how this was not the item I sent them. You could see very clearly how this was not the same one. They wouldn't even show the bottom which had a # of the item, double the proof they were ripping me off. Those statues have individual #'s and are limited editions. But no Ebay made me refund 100%. So now they are letting a seller rip me off. Just what is going on with EBAY???

·3 years agoSo I'm confused, and by more than the no-paragraphs conglomeration of a buyer issue and a seller issue. On the seller issue, you're strongly implying in your post that the buyer damaged the item rather than it being damaged in shipping. Yet in your response to the buyer's feedback, which stated that you accused the buyer of lying and damaging the item themselves (which is consistent with your story here), you state that you could see the damage to the boxes and insinuate that you voluntarily refunded rather than being forced to. So I'm left wondering which version is correct?

·3 years ago[as buyer] How could eBay force a seller to ship? Send out an agent to put a gun to the seller's head and tell him to ship, or else? Is that how eBay could also force a buyer to pay? How could eBay cannot force anyone to do anything?
[as seller] You said in your response to the buyer's feedback, "I was able to see the damage to the boxes," but now you are changing that story..?
Both transactions are water under the bridge, and there's nothing further you can do about them except try to learn from both and hope for better buying and selling experiences in future.

Regarding your sold statue issue....
Did you provide a prepaid return shipping label in order for the buyer to return the item? You did not need to issue the refund until AFTER you received the returned item.
EDITED TO ADD: In your post above, you stated there was no damage to the box, but in the reply to their feedback you state that there WAS damage to the box.
Also, curious as to why you are bringing this up with the transaction occurred over 6 months ago.

·3 years agoBTW, when you receive an item that's not as described, as detailed in one of the FBs you left, did you not know that you could open an item not as described case?
eBay's MBG for buyers is actually very good if used appropriately and in a timely manner. Have you read it?

·3 years agoit looks like you ran into a non performing seller with the tea set seller
ebay will do nothing at all.
the best thing I can tell you to do is to leave a red donut describing the fact that the seller has refused to ship
try to keep it factual with no name calling, others will be able to see what you have said
sounds like that seller is a toad

You situation as a seller is completely different from your situation as a buyer.
eBay has no way to guarantee, force, or any way to insure you get the item you ordered. All they can do is force a refund if you don't get it. If you escalate a case to eBay and eBay decides in your favor refunding you the seller gets an unresolved case defect which is honestly the most damaging thing to a sellers account. You also can leave negative feedback just be sure you don't mention the eBay case.

Ebay selling & buying does have risks not always avoidable.
Hopefully good experiences will turn out to far outweigh the bad.

eBay has never been able to force sellers to ship items, or buyers to pay for their purchases. Did you look at the seller's feedback profile page before buying from them? If you check now you will probably find that they have just started selling, and took ebay's poor advice to start auctions at a low price "to encourage bidding". This is a common issue with new sellers, and while they should ship the item, they cannot be forced to. If the seller is new, they may not have shipped your item within the stated period, because of the 21 day hold ebay places on all new seller's and those who have not sold anything in over a year, first few payments, which most new seller's do not know about. They see the payment status marked as Pending on their account and do not ship because of that. They may not respond to messages about shipping because they think they scam attempts.
When the seller cancelled the transaction or refunded you, they received a defect on their account. They may also have to pay the final value fees for the transaction. If they do that a few more times, they will probably be banned.
As for your selling issue, had you come to these boards much sooner, we could have told you how you might have been able to prevail, even though ebay sides with buyers 99.9% of the time. As it is too much time has passed for anything to be done about that now.

·3 years agoHave you posted about two different issues here?
Responding to the one where you did not receive your item, if the last estimated delivery date has passed by at least 24 hours, you can open an item not received case with eBay. It sounds like you did this and were refunded. That's all you can expect to happen.
As far the second issue, involving you as a seller, I will allow someone else to answer that one.
