    Seller Resold my Purchase to someone else

    On July 13th 2023 a buyer had accepted an offer I made on his listing and my PayPal account that was on file was immediately charged. When I was notified that the offer was accepted I went back to the listing and noticed the title of the listing had the wrong model number listed in the title therefore was the incorrect watch. I asked the seller to cancel the item because they had incorrectly listed it with an error so they agreed. Unfortunately because I had already purchased another watch I had spent the money I had in my bank account and tried to cancle the charge by going to PayPal, I started a case with PayPal thinking it would quickly stop the charge from moving forward and removing money from my account. That was a mistake because I then realized it would have to go through since the ebay transaction had to complete through certain steps so I canceled the case and PayPal told me I would not be able to open it once closed. So I move on to speaking with the seller and they had already purchased a shipping label but soon after we both agreed to cancel the sale since it was a sellers listing mistake. So they didn't cancel the sale because it showed an error there is a payment dispute that was open with the buyers payment institution in my case PayPal.. even tho it was closed the error still showed up on ebays end blocking any returns from starting. So I contacted ebay and they told me I would have to wait till the item shows past the arrival date that way I could start opening an item not arrived case. So that date came and I am unable to open an item not arrived case because it shows I had opened a payment dispute with PayPal. So I contacted ebay again and they tell me that the buyer was paid on the 16th and they received the funds since I had canceled the PayPal case the money went through to them. Ebay is telling me they are unable to offer buyer protection because it broke the policy once I started a dispute through PayPal even tho I ended that immediately. So the ebay rep advised me to speak to the seller and ask if they could refund me outside of ebay. The seller has had his account since 1999 and has over 700 sales.. I have something similar, I've been on this account since 2002 and have over 700 sales. We are both serious account holders. Now the seller is not responding. The big issue I discovered here is that the day I asked them to cancel the purchase and refund me they relisted the item with a different item number and sold my purchase to someone else. Would this not be considered selling stolen property? There is proof on ebay that it belonged to me and proof that they sold the exact watches to another buyer. Would I need to call the police. Ebay has filed an investigation but into the sale of my property that I just described but it will take weeks and I was told that there is little chance anything will resolve from it and that the seller likely knows he doesn't have to refund because of the buyer protection being closed on me. I am currently lost and don't know what to do. I am only assuming I should call their local police and have them arrested. What should I do? They have money I paid over $400 and they have sold my property to someone else. Please help I don't know what to do at this point. Thank you.

    I want to warn other buyers and sellers about a negative experience I had. A user purchased a watch from me and then opened a return request. Instead of returning the item, they sent back an empty envelope. Because the tracking showed “delivered,” eBay automatically processed the return and refunded the buyer.

    As a result, I lost both the item and the payment. I reported the incident to eBay, but no resolution was provided. I have since filed a police report for theft and submitted a fraud report with USPS.

    I strongly recommend caution when dealing with this user. Based on my experience, this situation was handled dishonestly and caused me financial loss, including additional shipping costs and a negative review on my account.

    Yes that was a your big mistake. You were impatient and did not wait for the selelr to cancel your purchase.

    Once you impatiently went to Paypal to start a claim Ebay blocked the sellers ability to file a cancel transaction.

    Since you have already filed two cases that have cancelled each other out, it would seem you have only your card provider left to fall back on. However, your previously filed and cancelled cases may have caused you a problem with that option, if you do not wait a bit before trying it.

     

    The only possible solution I see at this point would be to contact the seller, explain what happened and the mistake you made by too quickly filing a stop payment case with PayPal.  Apologize profusely, and ask the seller if they would refund you minus their selling fees and and the charge back fee if they were charged one.  Do keep in mind that since ebay collected a sales tax for your purchase, the seller cannot refund that to you, they never received those funds. Maybe the seller will agree to issue a refund.

     

    If they do not respond or deny that request, Then after a reasonable amount of time, a week should be sufficient.  Call the customer service number on the back of your card and see if it that point they will issue a charge back. You may have to take a screen shot of the message where the seller agreed to cancel the transaction, and send it to your card provider, as proof that a refund is due you, and tell them you have not received a refund as of yet.

    I'm going to answer various parts of your post separately because the big block of words is too hard to get through.

    The time to go back to the listing to reread it is BEFORE you make an offer. If you had read the listing and noticed a discrepancy between the title and the description or pictures, you would either have asked the seller for clarification or you would have found another seller with the correct item. YOUR MISTAKE

     

    2. I asked the seller to cancel the item because they had incorrectly listed it with an error so they agreed. 

    Since the seller agreed to cancel the order, you would get your refund once they did cancel. You were premature in going to paypal, thereby losing your ebay protection. YOUR MISTAKE

    Again, YOUR MISTAKE.

    Ebay cannot help you once you went to Paypal. You handled this transaction wrong every step of the way!

    The seller can't refund outside of ebay but they could issue a refund or a partial refund through the order. 

     

    6. I've been on this account since 2002 and have over 700 sales. We are both serious account holders.

    As a "serious account holder," can you blame the seller for being frustrated with what you did? You asked for a cancellation to which the seller agreed then without giving the seller enough time to cancel, you filed a chargeback, not only causing the seller stress but also costing him a $20 chargeback fee! How would you feel if a buyer did this to you? 

     

    7.  The big issue I discovered here is that the day I asked them to cancel the purchase and refund me they relisted the item with a different item number and sold my purchase to someone else.

    Again, you didn't give the seller time to cancel and refund! This is YOUR mistake.

    It's NOT stolen! You asked to cancel, filed a chargeback and the seller resold the item HE still owned. It was his own property he sold.

    There's nothing for the police to do! They have real crime to handle and your mistakes on ebay are not crimes committed by the seller. 

     

    While I don't disagree that the seller should issue a partial refund, deducting any costs he incurred (including the chargeback fee) and transaction costs, I'm not sure he's obligated.

    If you honestly believe the buyer is at fault when the seller is not being honest and withholding and ignoring someone who paid money for something you probably should be behind bars yourself and far away from selling on eBay as possible.     Paragraphs are your friend. It's difficult to plow through that expanse of unbroken text to extract the nuances of what happened. But the short answer is that you lost all coverage through eBay once you opened the Paypal case. The same would be true if you'd done a credit card dispute. EBay does that to prevent people from double-dipping refunds. You made things worse by prematurely canceling your Paypal case. Since you canceled the Paypal case the only option remaining is to dispute the charge with your credit card.

     

    As for calling the police in the seller's location, they will tell you it's a civil matter. And pursuing it in court is not going to be a cost-effective move.

    OK thank you for the criticism. I knew it wasn't written out neat enough to post, I was in a hurry. 

    I understand from this that the seller gets to keep free money regardless of ebay understanding and having proof of what's going on. That I should contact my bank and speak to them about a fraudulent charge on my debit card . 

    If I am unable to be refunded by my bank I will have to contact a lawyer because I want this individual behind bars where they belong.  Thank you for your response even tho I didn't really figure anything out that I didn't know already .

    Being in a hurry is the reason you're having this problem! If you'd given the seller time to cancel as you requested and he agreed to, you wouldn't be in the situation you now find yourself.

    It's not a fraudulent charge! You keep referring to "theft" and "fraud" but YOU made the purchase, YOU paid for the item, YOU requested to cancel, and YOU prematurely opened a chargeback through Paypal. 

     

    That the seller relisted and resold the item is because you told the seller you didn't want it and to cancel! How is that fraud?

    Good luck finding a lawyer to take this case! Be prepared to spend (minimum) $300/hour for the lawyer!

    Wanting someone behind bars and having actual legal grounds to do so are completely different things. And lawyers can't press charges to actually jail someone. That's the purview of DAs and grand juries, neither of which would come within a hundred feet of this. So contacting a lawyer will simply be throwing good money after bad. You made a mountain of mistakes here. The best approach would be to learn from them.
