    Seller mixed up boxes and other buyer refuses to send item back
                     

    So, my seller mixed up boxes and sent my item to another buyer and I got that buyers item.  The seller offered to send both of us return labels which I was fine with.  The seller then came back and said the other guy will just keep the incorrect box and if I was ok with that I could just keep what I got.  I told the seller, no I want my item (because there was something in there that I got that is worth a lot, for once I got lucky).  He said he has messaged the other guy and he is not responding (I think he knows what he got that is mine).  The seller said he will offer a refund to me......that is not the point.  I am still out my items I have bought and paid for already.   What further can be done?   Thank you in advance

    That could be why the other buyer won't return it.  Just get your refund.  Tell them NO it's not ok, I want my money back. 

     

    While buyers can file a case if they receive the wrong item.  There is no such case for sellers.  They can't file a I sent the wrong item and want it back.  No such case.

    I sense a seller that is promising the buyer that the item is going to be returned, & then they will forward it to the correct buyer. Then, this never happens, & the 30 day window for the Money Back Guarantee has closed. The buyer is then out of luck, as well as the $$$.

     

    Make the seller refund you ASAP by filing thru eBay's MBG!

    Just to update on my post, the seller told the buyer I was going to pursue legal action and the other buyer is now shipping the item back and the seller will ship it to me once he receives.  Thank you for the ones that answered my question if anything else could be done through eBay, and the rest that gave their input outside my question, just keep being sheep and letting people push you around.  I'm sure that will work out fine for you.

    Speaking of sheep metaphors, don't count your chickens before they hatch.  Everyone here hopes you receive a satisfactory solution, but, as the saying goes, "Have faith, but tie up your camel."  In other words, leave yourself a fallback option just in case the deal with the other buyer goes south.  I suggest that you consider going ahead and opening a Not As Described claim to protect yourself.  If things work out like you expect, you can always close it.

    What further do you think could be done except a full refund? The seller flying to the other buyer's house and camping on their porch until they turn over the item? Take the seller up on their offer of a refund. If they don't quickly make good on the offer open a return case. There are no other options.

    Did my question ask anything about asking the seller to do anything?   It was asking for advise on what further can be done through eBay since this is where I am asking.   That items legally became yours once you paid for it.  All I am asking everyone if there something that can be done through eBay.  I know the seller has offered but I am willing to handle this by way of the courts if I have to but was just wondering if there was an easier way.  But thank you for the condescending answer all the same

    Are you kidding me?? Seriously? Court!!! Stop fighting this. This situation don't work that way. Make this easier on yourself. A court will just do exactly what Ebay and the seller will do. Issue you a refund.  Nothing else can be done. The answer you are looking for is figuring out a way for the seller to ship the item you paid for doesn't exist. A refund is in order.     No assistance on eBay or anywhere else will be given to you. If you want to spend the money to go to their jurisdiction and the court MAYBE award you a partial refund then go on.

    And that's only Step One.  You then have to collect the monetary award.  It's only given automatically on Judge Judy.

    File the INAD and send it back for the full refund. The seller will pay the shipping back.  Nothing you can do, appears this happened in error.  At least you did not win the item at a very low price, and then the seller makes excuses and does not send the item you rightfully won at auction (happen to me several times on here) You make it sound like this was an honest shipping mistake by the seller, but his solution is unacceptable.  Again, just file the INAD and get your money back and move on.

    Sorry, but if the other buyer wants to keep what they received, nothing you can do about that.

    If you want to return what you received, open a INAD and the seller will pay return shipping and you'll get a full refund.

    Neither you nor the other buyer are obligated to send any thing back.

    Nothing can be done unless the other buyer opens a not as described claim and returns the item for a full refund. Which is basically what you should have done as well.

    It is the sellers responsibility to ensure his/her buyers receive what they ordered and not have to go through the process of returning items.

    Get your refund and go on with life because you will probably never see the item you bought.

    Ebay policy is you must file a return and return the item within 30 days. The seller is unable to send you the correct item cause the other buyer wants to keep it. That is uncontrollable to the seller. So you must look at getting a refund upon return. Your point that you are trying to make about you bought and paid for an item and you want it doesn't matter in this case. Save yourself frustration and return the item and get your refund.
