Seller hasn't refunded me for item even though he agreed to.
It has been over the time allotted by eBay and I can't find where to escalate the claim up to eBay.
Please help.

OP8 months agoI wanted to check back and let you know the results of this refund problem. It took over 20 days for the seller's refund to be initiated. During all that time no ask eBay for help button or link ever appeared.
I have no clue as to why or why such a long delay.

·8 months agoHere's the way it usually works per the eBay MBG: Buyer receives an item that is not as described. He opens a return request and used the reason "not as described".
Seller has 3 days to respond. His options are: sending a prepaid return label and refunding on receipt of the item. Telling the buyer to keep the item and refunding the buyer. No reply.
On day #4 after the buyer opens the case, if no response at all, as in #3, buyer returns to case and asks eBay to step in. He will be refunded from the seller's funds.
Hope this does not happen again, but, if it does, please keep the above in mind. Please note that there is no eBay requirement that the buyer contact the seller or get into a back and forth discussion.

OP8 months agoI do understand all that, BUT that is not what happened in this case. Also, the eBay system would not allow me to just open a return request immediately and wanted me to work things out with the buyer.

Don't confuse a suggestion that you contact a seller before opening a Return. Opening a Return claim is contact enough.

OP8 months agoThe system would not let you open the claim before going through that process.

·8 months agoWhich is very strange. Usually, when a buyer receives an item that's NAD, and it's still within 30 days of receipt, all he has to do is as outlined above. Did you do that exactly?

OP8 months agoWell, another day is almost done and I can't contact eBay to step in on this. The seller is now mouthing off that he now wants them back AND doesn't want to give me a pre-paid label but that I should just send them to him and then I will get partial refund only if I remove negative.
Really??
If you look at this guys feedback he has LOTS of negs, mostly recently and for the same thing, misrepresentation of amber, late shipping where the buyer has to go to eBay to get him to ship. He's smart. He prints a label BUT never sends it out.
There are some people that should not be allowed to sell on eBay and this is one of them. Sadly, anyone with a pulse, a credit/debit card and a phone/computer can register to sell these days.

OP8 months agoI am generally very charitable about people, but this is one seller that eBay can certainly do without. Apparently, he has been racking up negs for things just like this, not sending out, etc. He's smart, or so he thinks he is, by printing a label and then just letting the package sit for a week and more before sending out.

OP8 months agoOh, all my actions were through the eBay item not as described system so they are all on record.

OP8 months agoNow I am totally confused as what to do. The guy offered me the refund ON Jan. 15th and I accepted it the same day.

There is your answer...................................

OP8 months agoNot sure what you mean. I opened case in a very timely manner and, as far as I can tell, it is still open.

EBay gives the seller three business days to respond (and those days are calculated from the time the case was opened). You can't escalate until the fourth business day. So you should be able to escalate the case tomorrow.

OP8 months agoTHANKS - Silly me, I forgot Monday, was a holiday. Cross your fingers for me. This seller is weird.
twk
OP8 months agoNo, it has not been over the time limit.

Check the status of your case, and if appropriate, ask eBay to step in:

OP8 months agoJust want to add that he already agreed to a refund through eBay and now wants to reneg on by not giving it. I can't find a tab to escalate.

·8 months agoDid you actually open the appropriate case within 30 days?
After you opened the case, did you return to it and escalate after 4 days?
If you opened the case, and no action was taken by the seller after 3 days, you could've returned to that case on day #4 and asked eBay to step in. Not sure how a seller could "renege" on refunding.
It might be a good idea if, just for us, you'd recap exactly what has happened, including dates. Am assuming this is related to your message of a few days ago.

OP8 months agoI opened the case in a timely manner and the next day the seller agreed to a refund, no return, which I accepted. Ebay then said I should have my refund by Jan. 20. THAT has not happened and, the case seems to be still open, but there is no where I can find to escalate it.
Ebay said that if I didn't receive my refund by Jan. 20 that I could escalate it and they would step in. How do I do that???

OP8 months agoHere's what I have on the return page.
Refund by
Jan 20
The seller has initiated a refund of $30.00 to your original payment method. If you don’t receive your refund within 3 to 5 business days, you can ask us to step in and help.
There is no where to ask them to step in and help.

OP8 months agoI don't think he can reneg, but he sure wants to. First told me to keep them, now wants them back but doesn't want to send me a label. He is pressuring me to remove the negative I left him, this guy is a real piece of work.
As I see it, and I hope eBay does to, he agreed to refund me and for me not to return items. I accepted that, through eBay return system.

·8 months agoSorry you're having a problem. How, exactly, did your seller agree to a refund?
Did you open the appropriate kind of case per eBay's MBG?

OP8 months agoI - yep I am the one. I opened an item not as described case. The seller agreed to refund, which I accepted and it shows that the refund was to be completed by the 20th. Now the seller says too bad, I'm not refunding, etc. There is nothing in the case that I can find to escalate this to eBay. I opened case on the 14th and he agreed to refund me, on the 15th. The eBay case showed it was to be credited to the way I paid for the item by the 20th. So far, nadda.
In fact, the seller, who scares the begesus out of me with his talk of his partner, suicide and all kinds of stuff I don't need to know and don't want to know, wants the item back but doesn't want to provide a label. He didn't want the item back originally.
He did try to blackmail me about giving me a refund IF I would remove the negative feedback I left for him.

OP8 months agoI opened an item not as described case on Jan. 14th. The seller sent me an offer to refund on Jan. 15 and I accepted. Then it shows on the case what I posted above.
