Seller from China does not send the package and denied my cancelation request
I won a $70USD auction from a seller supposedly living in China on September 23rd. I made the payment the same day and i'm supposed to receive the package between October 6th and 17th but there is no chance of receiving the item within that time because it has not shipped yet. I requested a cancellation but the seller rejected it even thought the package hadn't shipped .
When should i request the "Item Not Received" process, considering that the seller will likely send a fake shipment that will never arrive, and i will have to wait 3 days for Ebay to take action in the case?
If i wait until the last day of the delivery window then Ebay will wait 3 more days to initiate the process, so it will be in Oct 17th + 1 day of waiting due Ebay rules + 3 more day for Ebay to take in action in = Oct 21 or Oct 22.
The problem is that the refund window only works 30 days after the payment and it closes on Oct 23.
What should i have to do?

First off, ebay's Money Back Guarantee (MBG) protections for Item Not Received (INR) start one day after the last estimated delivery date Oct. 18th in this case, and you have 30 days to file it from then.
On Oct. 18, if the item has not arrived file the INR dispute. The seller will have 3 days to prove delivery, a tracking number with a delivered scan. If they do not, on day 4 go to the dispute which will be just above the item title in your purchase history, click on it, then click on the ask ebay to step in button. They will issue a refund from the seller's account. I suggest if there is no tracking number uploaded by then that you take and save a screen shot of the order details page on the 16th showing one was not uploaded.

Has a tracking number been uploaded to the order details? If one has it is most likely a USPS, FedEx or UPS tracking number. That means the seller has shipped internationally using a China based service that partners with a domestic carrier. Until the item arrives in the U.S., clears customs and is handed over to the domestic carrier for last mile delivery, the tracking number will not update.
In the future I would not buy from a china based seller on ebay. They are responsible for 90% of the scams pulled on ebay, and they know how to get around ebay's MBG. Even though you have thirty days, don't take your time about it. Don't dally about. I'd open that dispute on the second day after the last estimated date.

How do you even thought the package hadn't shipped?
And now the seller did ship after all, but it's a fake shipment that will never arrive ... so what's the point?
Why isn't it for up to 30 days after the last estimated date, like it is for everyone else in the eBay Money Back Guarantee?

I saw that the shipment wasn't registered so contacted the seller. Indeed, the shipment hadn´t been made.
I mentioned the fake shipment because a year ago a seller asked me to wait fo a delivery that never arrived, but when the INR started, the time limit for requesting a refund expired (I suspect it could be a similar situation)
Thanks to your answers i realize i didn'd understood the INR rules. I´m happy to know that i have 30 days after the estimated delivery time.
