Scammer put in fake tracking and EBay closed case 30 month seller feedback reflects this

So I purchased a yeti cooler. Glanced at seller ratio which looked fine but did not look at most current feedback. Seller promptly put shipped (no tracking). I messaged multiple times over 2 weeks for tracking. No responses from seller. Looked at feedback again and noticed in the last 30 days not a single good feedback. I opened a case of item not received the day I was allowed and the next day I received notice that item was delivered the day before. Tracking from UPS only showed city and zipâ€¦no photo or address just delivered to door. I have cameras so I check and there wasnâ€™t a UPS delivery. Called UPS with tracking and UPS agent told me that it was not my name or address attached to the tracking number AND that the shipment was from Amazon. Would not give me any other info. I put in a dispute with EBay stating all of the facts and for them to check the sellers 30 day feedback and that I thought the seller profile was hijacked. EBay closed case same day saying tracking showed it was delivered to my address but the tracking â€œproofâ€ was just city and zip with no photo. I asked for them to look again and actually look at what I said. They just closed the case again. It is the weekend and eBay would not let me talk to or chat with anyoneâ€¦just running through email.

Is there anything I can do? What is the next step?

Sadly this has been happening a lot. Even with purchases made EVEN within the USA. Just wait for the expected delivery date and file a claim with ebay and you have to follow up. In the old days ebay booted bad actors, now they only care about fees. @kensgiftshop provides the answer of what you had to do with ebay and it's a pain, but needs to be done. Also take the time to look at @ittybitnot posted.

The best protection that an online buyer has, on any site, is the ability to open a dispute with their credit card issuer.

That assumes you were prudent enough to pay by credit card.

You are their customer, not the seller or Ebay. They are aware of all of the legal protections you have in law, and under the Visa and Mastercard regulations.

They make the decision, not Ebay.

When an order is shipped to other than the addresses registered with your credit card, they are 99% likely to rule in your favor. Ebay and the seller are required to provide proof of delivery to a verified address associated with your card.

Credit card providers require proof of an item not being received before they will do a charge back. They cannot access a shipping label's address or the package type/size/weight info either, due to Federal postal privacy regs.

Their procedure is in such cases to ask for proof of delivery with an address. And thet check for one of their verified addresses. Buyers can addresses to the default which is the card's billing address.

Burden of proof is on merchant/seller. Tracking is not enough. There is no possible proof of item not received. Ebay accepts a lower level of proof, and that is the root of this fraud.

Ebay practice is a combination of past practices on PayPal and Amazon. All of which were higher risk to the seller but more convenient to buyers who wanted to ship to their office or ship a gift.

When tracking doesn't work....

And when the same scenario happens time and time again with the same seller...

My point...a real employee should see this and put a stop to it...but I guess it's because of artificial intelligence which can't think of a situation like this.

I notice 50 were available of one item for sale and all sold...LOL

Or maybe having the 'total address' on tracking as shown 'delivered'...but that might be too complicated for an employee...

Get a letter from UPS stating the package with that tracking number was not addressed to you.

Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.

If a shipping label is provided, ship them a copy of that letter.

It appears you are likely one of today's victims of the "fake tracking scam". No matter where you seek redress, if you use "Item Not Received" (aka INR) you are going to lose. It has been going on for years here, but you must get the INR out of your head and start thinking FRAUD/FAKE TRACKING SCAM instead.
