Scammed - Product never Received
I purchased a bracelet on eBay in November. It shows as delivered via UPS in early December. The delivery shows a picture of the porch it was delivered at. However the pictures are someone else’s porch. I provided pictures of my house to eBay and the seller but they refused to resolve the issue and just state their only obligation is to ensure it is delivered somewhere. The carrier won’t speak to me since I wasn’t the shipper. So I am out several hundred dollars for a bracelet I never received and eBay ignored the evidence I provided and denied my appeal. The case number is 227103237984 and the order number is 22-13875-61153. Any suggestions on how to get this escalated?

·9 months agoYour best course of action is to open a dispute with the bank which is the issuer of your credit card.
Make it clear that the address which it was delivered to was not your address.
A credit card chargeback dispute makes greater requirements of proof of delivery than does an Ebay INR claim.
You are likely to be successful with this method.
Your credit card issuer is likely to be well aware of this type of scam.
If you paid with other than a credit card, you should open a dispute with that payment method but the prognosis is not as rosy.

EBay has no idea if the picture you sent of your house is actually your house, so that kind of photographic evidence is worthless. The first thing you need to do is to contact UPS and ask them 1) where there GPS data shows the item delivered and 2) whether the package was addressed to your address. You don't have to be the shipper to get this data.
If the package was addressed to you but misdelivered that's between you and UPS. If it wasn't addressed to you you've been a victim of the fake tracking scam. If you can get an official communication from UPS stating that the package wasn't addressed to you you can use it to appeal eBay's decision. But it will be easier to simply dispute the charge through the fraud department of your credit card.

·9 months ago'bracelet'....small box I would assume it is in...'pictures are someone else's porch'.
I would think a small item would go in a mailbox.
Do you not have a mailbox?

·9 months agoIt's illegal for anyone other than USPS to put something in a mailbox.

·9 months agoI wonder why that is?
In Australia you can stick a note/letter in a mailbox rather than leave it on the front door etc.
I mean the resident actually owns the mailbox, not usps.

·9 months agoIn the United States, residents (or property developers in the case of cluster box units) are responsible for buying and installing a mailbox, but federal law gives USPS jurisdiction over the mailbox. If a mail carrier opens a mailbox and finds a non USPS postage paid package inside it, they can legally take possession of it or they can refuse delivery of your USPS mail until the package is removed. Many carriers won't care, but there are plenty of hard-nosed ones who are strictly by the book as they are supposed to be. They get audited, and nobody at USPS wants to fail an audit.

·9 months agoPictures of your house doesn't prove anything.
How are they supposed to know if that's your house or not?
Contact UPS and ask if the package was addressed to you.

OP9 months agoThe pack was addressed to me and according to UPS delivered to my address. But it was not actually delivered to my house and the picture in the UPS delivery confirmation is not my house. I can contact UPS to get tracking information. However, only the shipper can file a claim. The shipper and EBay are both just hiding behind the fact that it was delivered somewhere. I did dispute it with my credit card company but I think it’s kind of crappy that both this seller and EBay don’t care to follow up on the facts provided. eBay even acknowledged I provided them with this evidence and proof but just went to their standard so sorry, sucks to be you statement. The seller just went quiet. I guess you can’t trust eBay to do the right thing. Lesson learned.
