I was scammed BY [Removed] on Feb 22nd
even fighting to get a refund for 29 days and counting. 3 appeals with undeniable proof that the seller manipulated the delivery address. Called today 3/21 eBay claimed another 3 to 7 days for refund. At this point I have zero faith in eBay and their 100% money back guarantee.
I’ve been a member for 23 years and have never had this much trouble with eBay refunds from a proven fraudulent seller.
im writing this in Hoping that someone else that was scammed by this seller will see this and reach out. eBay makes it almost impossible to get a refund these days.
someone please help me get a refund. I have spent countless hours on the phone with eBay to resolve this and still no refund.
i left negative feedback and then it was removed by eBay because item shows delivered in my area code. eBay does not see the street address nor do they care.
I reported the seller 3 times now and eBay has denied it. I’m at a total loss

For a person who has been using ebay for 23 years, you sure seem to have missed the indications that the listing you bought from was a scam.
The price should have been the first red flag, being about half of what the trending price for that item is, even if it was listed as New other.
Then there was the seller's description which stated"Never got to put "it" to use so its been sitting in the gun safe" "It" not them, and they had 12 for sale? I have a dozen or so scopes but all have different Mfrs., magnification power, reticles, lighted or not... I do not have more than one of any one of them.
The seller not having received any feedback As a seller should have been a warning that there could be a problem with the sale. You have been selling for a long time and maybe you started selling before ebay instituted their 21-30 day hold on all new seller's payments back around 2012, which many new sellers do not know about or how to deal with, to get the funds released. A very common issue these days.
As for ebay dealing with the "Fake Tracking scam" as it has come to be called. They are hamstrung by Federal postal privacy regulations, which do not allow a person/entity whose address is not on a shipping label, to access a label's address or package type/size/weight information. The initial INR dispute is looked at by a computer that can only check for a Delivered scan and the zip code, which if it matches yours results in a denial of the dispute (which is why your feedback didn't stick)
Appeals may be handled by an ebay rep, but that is questionable.
The info provided by @glorybells , can help, except for:
b) If your name and address weren't on that label, ask the postal carrier if they will put this in writing. Also, ask for the weight of the package using that tracking number. Asking a clerk to write a note on a shipper's stationary has to be done carefully or they will refuse, more about that below.
You say you have proof of the non-delivery, if it is an email from the shipper, ebay will not accept it, because emails can be faked, but the email might be helpful if you take it to a P.O. or shipper's store along with the other info.
When you to go to your P.O. or a shipper's store. You need to bring a copy of your order details page which shows your address and the tracking number with you. If you bought using a phone or tablet, you can bring that to show the clerk the order details. You want to ask the clerk to check the label address against yours on the order details page, and also to check the Package type/size/weight info to see if was is appropriate for what you should have received. If you can look up the Mfr.'s specifications for the item and bring that with you as well.
If the info does not match up, you ask the Clerk or Postmaster to write a note on USPS stationary saying in general that the shipping label's address was not the same as the one on your ebay Order Details page, and if applicable that the package type/size/weight was not right for what you should have received. The email from the shipping agency might help sway them to write a note if it is on a phone or tablet. Do not ask them to write specific address or package info, they cannot give it out. Have the clerk or Postmaster print their name then sign and date the note. If they won't write the note Ask the clerk to give you the GPS location of the Delivery on USPS stationary, l and hold on to it.
Since ebay has shut down 2 of their 3 social media platforms to customer service / fake tracking issues, You can try the instagram link below. If you get a note attach a CLEAR photo or Scan of it to the message.
If that fails then you may have to file a claim with PayPal or your Credit Card provider. PayPal has an option for delivered but not to my address or similar wording that you should use. Your card provider should be told the same thing. It helps if you provide as much proof as you can, when going those routes.

It's against Community rules to 'name and shame', so a mod will soon remove the seller's name.
EBay has been slow to learn how to deal with the fake tracking scam. Your best option now is to turn to the fraud department of your credit card issuer and dispute the charge.

I would obtain the photo from the shipping company and use it as part of your proof of false tracking. This can help if the package shown as delivered is much smaller or large than what you ordered.
1) First, call the postal carrier to see if the tracking number label had your name and address on it.
a) If your name and correct address were on the label, ask the postal carrier to review the GPS on the delivery, retrieve the item from the wrong house, and deliver it to you.
b) If your name and address weren't on that label, ask the postal carrier if they will put this in writing. Also, ask for the weight of the package using that tracking number. Follow the rest of the steps here:

Include these phrases
Seller uploaded tracking not associated with my transaction
Tracking details were not accurate
Seller use a false tracking number
Don't write a novel, it's initially being read by a computer, that's why I want you to use those 3 specific phrases in the message.
3) Finally, contact Customer Service and inform them that the seller uploaded a "false tracking number" on your purchase. Request a refund.

If the above steps do not result in a refund then you will have to pursue a chargeback with your funding source ( bank, credit card, etc) . Once you ask your funding source to step in eBay can no longer assist you.
