Received item

Question

I received an item that was clearly falsely described. It was listed as an XL t-shirt, and what I received was a small. I was told by the seller, "Sorry, we do not accept returns." I went through eBay and was told "case closed." How can a seller get away with this ?

I fear you've fallen into a trap that eBay should explain far better. When you opened the return case did you choose 'Does not fit' as the reason? If so, eBay considers that to a remorse return, so the seller's no returns policy applies. Had you selected 'item was not as described in the listing' as the reason the return would have fallen under the Money Back Guarantee, which overrides the seller's return policy.

If this is what happened your only recourse now is to dispute the charge with your payment source.

You might want to re-read the Money Back Guarantee for buyers. It discusses the different kinds of cases a buyer can open with eBay as well as the ramifications of each.

@kathiec has provided the answer. You chose a buyer faulted reason for the return.

Open a dispute with your credit card issuer, stating that the size was not what you ordered and the seller refused to accept a return.

Did you file an "Item not received" case? That's why it closed because the item is considered delivered. You needed to file an "Item not described" case against the seller and return the item. Just because the seller stated "We do not accept returns" doesn't mean that Ebay won't force them to. They must accept returns if you file the proper case against the seller.
