Received Completely Wrong item, Seller Can’t Help
At the beginning of the week I ordered a fairly expensive collectible figure for a price that was cheaper than average, but not cheap enough to raise any suspicion. Cut to yesterday and I receive the package and already I’m not happy. It looks like the item was stuffed in the box and the box itself was open and being held together by tape. I open the box and quickly realize this isn’t close to the figure I ordered from the seller, it’s just a pair of sneakers. I message the seller about this and they keep telling me that’s not what they sent, but where I’m standing I do not have my item and now I have this pair of sneakers that are three sizes too big. The seller has around three thousand cases of positive feedback and is at 100% so I can’t imagine they would pull something this stupid. The only thing giving me pause is that I’m pretty sure I bought the “last one” of that item at the cheaper price, and now there’s still one more available at $10 more, but who’s to say they didn’t just get another in. I’ve considered that perhaps UPS swapped the items in the box during transportation, but I don’t know how to prove that or what the seller can do for me if that is even the case. Any help here would be appreciated.

OP3 years agoYes, the follow up is now gone and eBay refunded the rest of the money. Hopefully the seller moves on so I can move on from it as well.

·3 years agoHave you actually opened the sneaker box to make sure it isn't the item you ordered packed inside a sneaker box? Inspect the actual contents and if it is not what you ordered then open a NAD and return the item for refund.

·3 years agoIf you had read the OP and thread you would see that he did open the box AND he already returned it.

·3 years agoNowhere in the original post does it say he returned it. Also just says it is sneakers 3 sizes too big. That could be ascertained from the sneaker box without actually opening it to make sure that is what is inside.
rlrl68
·3 years agoThat's why I said "the OP and the thread" where he says he returned it. Sorry, I guess when OP said "he opened the box" I shouldn't have assumed he actually opened the box.

The photo in the OP shows TWO boxes ... so we don't really know for sure that both boxes were opened.
I didn't pick up anywhere in the thread that anything was 'returned' ... BUT the SELLER left a Follow-up to their original feedback that says the buyer returned a fake pair of Jordan sneakers.
@rpm0716
Aside from completing the return request ... BE SURE to contact eBay and ask them to remove the Follow-up the seller left to your feedback. They used your real name in the comment and violated policy in more than one way.

OP3 years agoThank you for letting me know about the follow up comment! I was hoping that was the end of it, I would not have even noticed if nothing was said. I have been in contact with eBay chat and am trying to have it removed. I suppose I should be glad they didn’t reveal all of my personal information but even listing my name in such an unflattering comment didn’t sit right with me.
As for the sneakers: I don’t know what they are or where they came from but they were sent back to the seller exactly as I received them. The sneaker box was technically “opened†as I opened the lid to make sure they didn’t throw the item in that box. Upon seeing the sneakers I closed it up and put them back in the shipping box as I received it from UPS. I do not buy or collect sneakers, and my point of mentioning the size was to illustrate I would have had no reason to be in possession of them otherwise. I don’t know if they actually were fake or if that was just said by the seller to make me look bad, but that is what I received in the package with their UPS label and that is what was sent back.
I hope to now be done with this issue, and thank you to everyone for all the advice and suggestions.

You should have had no problem at all getting that Follow up removed IF you spoke to a CS rep that understands eBay policy. It should have been removed immediately ... and I see it is still there.
I would try again ... and contact the most experienced/helpful CS reps that eBay employs, which are located on social media.
Aside from asking for the immediate removal of the feedback comment ... you also can ask them how best to get the rest of your money refunded. They should be able to do that as well while you're on the phone. [They are given more authority than the reps you reach through the eBay link.]

EDITTED TO ADD:
I forgot to ask how you returned the shoes? Were you sent a prepaid shipping label as a result of your return request ... or did you purchase a return label yourself?

OP3 years agoUpdate here:
Based on the suggestions here, I went ahead and filed a return with the item not matching description.
As I more or less expected, the seller only refunded me 50% of the purchase back and basically called me a liar and said they reported the transaction and my account to eBay, hoping to have me kicked off of the platform. I have NEVER returned an item on eBay as I’ve never had an issue, which is exactly why I came here for advice. There is the option to have eBay step in by opening a case, but is it worth it? I don’t know how that works so I don’t know if there’s the possibility of them ruling in the seller’s favor and having the 50% refund taken away.

·3 years agoYES. By all means ask eBay to step in and decide. No they can't have you kicked off as they sent the wrong item! It's a bluff. And a poor one at that.

·3 years agoHi @rpm0716
ABSOLUTELY ask eBay to step in. You’ll likely be issued a full refund within hours.
You’re at no risk whatsoever of losing the money you received.
asset_liquidators
·3 years agoAsk ebay to step in. If they sent that 50% offer through the ebay case then do NOT accept it as that would close the case because that would signal that you were satisfied with the resolution. Also, make sure you are only conversing with the seller through the case and not just messaging back and forth.

·3 years agoIs there something her that we are unaware of? When you open an item not as described case, the seller has just a few days to send you a prepaid return label and to refund in full within a few days of receiving the returned item. Have never ever heard of a seller being able to get away with only a 50% refund.
It doesn't matter what the seller threatens to do -- he can't.
sapphire_studio
·3 years agoThere is a seller protection where you can take up to a 50% refund off if the item is returned to you damaged and you are a top rated seller. It doesn't matter if the return is item not as described or remorse. Obviously in this case the seller abused that seller protection.
Usually When a buyer contacts eBay and complains about only getting a 50% refund eBay will just pay that 50% and eat it themselves. I'm sure they have a metric system in place to make sure sellers are not abusing that feature and using it too often.

That, or possibly UPS did some creative repackaging, and someone that was expecting some sneakers got a fairly expensive collectible figure 🙂
