Received a partial order, seller so far unresponsive to my e-mails
A couple of weeks ago, I ordered the last two sealed cases of "Blind Box" pins from a seller. Each case is supposed to have 10 smaller boxes inside, etc. The shipment was delayed in arriving due to the snow on Monday last week, and then UPS not putting it on the truck on Tuesday, so I finally got them on Wednesday, which of course I do not fault the seller.
When I opened the shipping box, I found 2 cases of the pins inside, however one was not factory sealed in the plastic like the other was, and when I flipped the top open, I saw it only had 8 of the 10 blind boxes inside. I opened the other case and they had the 10 pins as expected. I sent the seller this message that Wednesday evening:
After a battle with UPS due to the storms here in Maryland, the package finally arrived this afternoon. Thank you for the prompt shipping.
However, when I opened the package, I noticed one of the two brand new cases of 10 was actually unwrapped, and when I lifted the lid, I noticed the case only had 8 of the 10 pin boxes inside. The other case was still factory sealed in the plastic, so I opened that to double check and that one had the 10 pins inside. Please let me know how we can address this
I sent two follow up messages with no response until this morning when I received a short message with the tracking number, but no comments to the actual issue.
I want to keep these as they are not easily located at retail, but I feel I should at least get a partial refund on the incomplete case, since each sealed case was $90 and this one was not sealed or complete, but if they are not responding, what are my options?

·1 year agoYou can return them for a refund. That is what eBay allows. So, file an item not as described case.

-- you will lose the case because tracking proves that everything was delivered.
Instead @3576betsyd click RETURN THIS ITEM
-- to start a return request with the MISSING PARTS OR PIECES reason
-- upload a photo showing that 2 boxes are missing, add two lines of comments, then Submit.
Your seller will either reply with a partial offer, issue a prepaid return label, or ignore you.
If you get a partial offer, you can either accept, get the refund, and the case will close. Or if you decline make sure to immediately go back to ask eBay to step in it ... before the seller can take another step.
If you get a prepaid return label, send the missing items back in an empty box to get your refund. .. for those MISSING PARTS OR PIECES.
If you're ignored, eBay will automatically step in to refund after 3 business days.

OP1 year agoI did not open a case about the item. I opened the cases that I purchased.

·1 year agoSounds like you opened an "item not received" case, eBay saw that you DID receive something and closed the case.
The case you needed to open would have been an "item not as described" case. You would have been sent a prepaid return label to return the item and get a refunded.
You quite possibly would have, at first, been able to negotiate a refund with your seller.

eBay no longer allows buyers to request partial refunds, but allows sellers to use that option as a reply, when disputes are filed.
It seems your seller's reply of sending you a tracking number means they are thinking you will open an item not received dispute, which a tracking number would win for them.
So maybe you should let them know that unless they respond with a better solution, don't say what, than proving delivery, you will file an Item Not As Described dispute for missing parts or pieces, in which case they would have to pay for a return shipping label for the whole order, or they could send you a partial refund probably saving them some money. What ever you do do not mention a partial refund price or Feedback.

OP1 year agoBecause as I look at it, I have 1 of two options, A) Item has not arrived or B) Return Item to Seller. It is not letting me do a "Not as Described", unfortunately, which is why I reached directly out to the seller, as any reasonable seller would attempt to make it right

Since buyers no longer are allowed to request a partial refund for some reason … which seems to be the most logical solution for this problem … I would consider phoning your credit card company and requesting a chargeback of 10% of the purchase price.

OP1 year agoI did not know buyers could no longer request partial refunds, though I did not request anything per se, I just asked how can we resolve the missing boxes, like if he sent me the wrong case, etc. I paid via PayPal for the items in question

Then the seller can offer a discount or request a return.
Stop messaging the seller and file the not as described case.
Im assuming you dont want to keep what you got for the price you paid so it is best to follow the advice given.

What payment method did you use to pay with via PayPal?
If it was a credit card … then your best solution IMHO is to request a 10% chargeback from your CC company to compensate for the 10% product missing from the total order.
I do not believe that PayPal supports partial refunds, which is why I didn’t recommend contacting PayPal itself.
eBay DOES support partial refunds … but only if the buyer and seller agree to one. Since your seller isn’t addressing the situation head on yet … and you can’t request a partial refund (and don’t want to return the entire item) … I’m not recommending filing a case with eBay.
[It’s certainly not wrong to file an ‘item not as described’ return request with eBay as @soh.maryl suggested … it’s just not the most practical action to take IMO.]

OP1 year agoI know I can return them, but as I stated, I want to keep these if possible since they are not easily located at retail and even then, you pay $10 per blind box, so at $90 for 10 blind boxes, it is a good deal, but I only received 8 blind boxes

·1 year agoWhen you file an INAD, it'll be up to the seller if they want them returned or to offer a partial refund for what you didn't receive.

·1 year agoSince eBay has eliminated the option of asking for a partial refund I'm not sure if there's a way in their return process to communicate that you want one. But all eBay can force a seller to do is refund in full after everything you received is returned. So if the seller won't respond to your you'll be faced with the choice of returning everything for a full refund or just deciding to keep what you've got and move on.

·1 year agoYour only recourse is to proceed to your order, open up a return request for the reason Not As Described. You must do this within 30 days of receipt.
The sellers must provide you with a return label or you can ask Ebay to step in. If Ebay steps in you will receive a refund and can keep the item.

·1 year agoGo to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.
