Purchased an expensive collectible, seller lied on the listing and is basically drop-shipping it
As the title says, I feel I’ve gotten scammed.
I purchased a $300 collectible (Lego minifig) and even though the seller stated in the listing that I’d get “exactly the minifig as shown in pics†it turns out he never had such collectible, and is basically drop-shipping me the fig part by part, because the original had some “damage†of some sort, even though the pics contradict that.
At this point, this scammer is basically asking me to wait for the parts to arrive (which he is sending with different tracking numbers, drop-shipping the parts from BrickLink, something I’m sure breaks the ToS) and I’ve only received the head from a random BL seller. The tracking number he posted was shared with another much cheaper minifig I did get from him, marking the original order for the expensive minifig as delivered.
I’m blown away that a seller with 100% positive feedback and 8.4k items sold somehow thought this would be acceptable.
At first I was thinking of filing an “item has not arrived†case but I fear the automated system will see “delivered†and call it a day. I feel the best option for me now is “received not as describedâ€.
Anyways, has anyone gone through this horrible experience? I feel that since the seller lied about the listing that should nullify the order and I should automatically be given a refund because who knows when I’ll get the rest of this minifig and I don’t want to be out $300.
The seller keeps promising to refund me but he now wants me to wait (however long that is) for all the parts to arrive and then return it, something I feel isn’t my responsibility whatsoever, since he’s the one lying about the listing and doing something completely unreasonable.
Thank you for your input in advance.

·2 years agoALL eBayers, both buyers and sellers need to make themselves acquainted with the Money Back Guarantee for buyers, preferably before beginning to buy and sell here.
Are you saying you have not yet received this item, but you somehow know it will not be as described?
There was an estimated delivery date in the listing when you bought it. Has that date passed by at least one day? Frankly I can't tell if you have actually received it or not.
If you've not received it and it's more than a day late, open an item not received case.
If you have received it and it's not as described, you have 30 days to open an item not as described case.
There is, and there never was, a requirement that you engage in discussion with this seller.
Respectfully, suggest that you take the time to read or re-read the MBG. Situations such as this can usually be handled easily without hassle if you have the knowledge.

OP2 years agoDid you even read what I posted? Cause your response shows you obviously didn’t. I’ve been selling and using eBay since 2007, so I’m more than familiar with the policy you’ve suggested, but your response shows you didn’t even read what I posted, why even rely at that point…
The reason for the ambiguity in my choice is simply because I’m getting scammed. Don’t think that’d be that hard to understand. I’m the victim here and you’re portraying my post as an indecisive uninformed one, so misleading.

·2 years agoYes, absolutely you should file a "Not as described" claim. You didn't get the figure; you got a head and some promises. Stop communicating directly with the seller.

·2 years agoYour situation is completely understandable, I had a similar experience around last year and eBay was able to help me out with the matter and resolve things with the seller.
I hope you get the return you deserve.

OP2 years agoBy the way, forgot to mention, I told the seller I don’t mind returning the parts once they get here but he should be a man and refund me for scamming me, never letting me know in advance what he was planning on doing. Had he told me I would’ve asked him to cancel the order. It just sounds shady and scammy. I also left negative reviews because other buyers might go through this as well.

I would file a Refund Request now, and do not do further business with the seller. Return the piece you already received.

·2 years agoYou need to quit the back-and-forth with the seller. Where has it got you so far?
Usually it's best to wait til a transaction is over and done with before leaving FB.
You have 60 days. Holding off on FB gives everyone time to simmer down a bit.
