Purchased a item I now feel may be fraudulent.
I had purchased/won an item listed on eBay a few days ago. It was listed as new in open box. I went to the manufacturer's website to see if there were parts for sale. While there I looked at reviews for the product I purchased. The very first review included photos that were the exact photos from the listing I had won. The review author had fired the pellet gun many times. I went back to eBay check the listing again. I noticed the seller had no feedback. I sent the seller an email to address my concern. I haven't heard anything back from them. The auction ended just on the fourth. I'm wondering what I should do next?

What 1234james..., wrote is not completely correct.
ALL new sellers will have a 21 to 30 day hold placed on their first few payments, and most of them do not know that. (30 is days for more expensive items).
On their account page your payment status is marked as Pending, so those sellers do not think the funds have been received yet and do not ship. Since your seller is responding you may want to message them again, and tell them to do a Google or other online search for "Payments on hold - ebay" If they do that they will get the information needed to ship the item and get the funds released within a few days of tracking shows Delivered.
Since most phones made in the last 5 years have pretty good cameras in them, you may want to suggest that they read through their phones manual to see how to use the camera feature. It may have a default setting to take lower quality photos, and not know that. If they don't have the manual, they can search for it on line by Mfr. and model number. They can also look online for tutorials on how to use a phone to take close up or product photos.

Here's the problem...new sellers do not receive the funds of a buyer for 30+ days...will seller send it before he gets pay? Took photos from a web site...but use phone to take photos....without using a computer?
You have to wait until estimated date of delivery...then file for item not received.
And is there tracking yet?....no tracking for week I would assume nothing coming.
This is just my personal opinion...from experience on buying and selling.

OP2 years agoThe seller has finally reached out to me. They said they used the photos from the site due to only having a phone camera with low quality. They say they will send photos of the actual item when they return home.
Thank you all for your replies and reassurance. I will give an update as to how it goes.

·2 years agoMany Sellers and Many items sold are listed using 'another listing' which is perfectly legal/ok to do and or the 'manufacturers pictures (which some manufacturers don't like) but either way..
How does a 'google search' showing a review of someone firing the gun have anything to do with the one you purchased- and how does it make it 'fraudulent'??

If you post photos of a 1lb Box of 16d Gal Nails or White Diamonds Perfume or Hanes T-Shirts but NOT necessarily the one you are selling- this is perfectly normal.
Your 'vehicle' example is NOT the same.

My example does apply to this case. It would if it were a used cellphone, comic book, or pocket knife as well. Sure if you're buying underwear and the post has photos of some other used underwear it may not matter to some 🤷ðŸ½â€â™‚ï¸, yet it would myself. To me it's a shady sales practice.

·2 years agoMany infrequent Ebay sellers copy any image they can find of the item that they are selling from elsewhere on the Internet.
The item may be in better condition than the one pictured.
Unfortunately, until you actually see the item, you will not know what you bought.
The seller may be lazy and an intellectual property thief, but might not be cheating you.

OP2 years agoThe seller finally reached out to me. This is the case. He is a new seller and says he only has his phone for photos. He says he will send photos of the actual item when he returns home. Fingers crossed

·2 years agoIn any situation such as you might anticipate, eBay's Money Back Guarantee for buyers offers very good resolution for buyers.
Get it and it's not as described? Open an item not as described case.
Don't receive it at all within a few days of its estimated delivery date? Open an item not received case.
You have 30 days afterwards to use either of the above-mentioned tools.
And even if a seller specifies "No Returns", that means nothing in the face of the MBG.
You might want to refresh your knowledge about the help the MBG offers.

·2 years agoAll you can do is wait for the estimated delivery date to pass.
If you don't receive the item, a day after the estimated delivery date Ebay gave you, open an Item Not Received case.
Go to your purchase history and click I didn't get it in the menu next to the item.
The seller will have 3 days to provide a tracking number showing it was delivered or refund.
If they don't, return to the case on day 4 and ask Ebay to step in.

·2 years agoAlthough eBay doesn't define it this way, almost every "open box" listing is a return or demo that has been lightly used in some way. Yours appears even more than that. You will be able to return it for refund as NAD (not as described), even if there is a no return policy.
