·3 years agoWhat extra right does the buyer have in this case? If the item the BUYER CHOSE to buy is shipped as the BUYER requested by making a commitment and paying for said item.
The seller shipped the buyers chosen item.
What other right does the buyer need?
The buyer is being shipped the item they chose by their own right..

No, it's not.
According to Ebay's MBG, buyer's remorse does not qualify.
It's up to the seller to choose whether or not to accept your returned item that you purchased by mistake.

OP3 years agoFTC cooling off rule, three days. Anyway the problem has been solved for those of us who are not perfect. My bachelor's degree is in business management and this is the way the smart sellers end up getting more sales out of the customer then the customer even thought they were going to spend you catch more with honey, honey.

·3 years agoThe FTC Cooling Off Rule provides that it is unfair and deceptive for sellers engaged in “door-to-door†sales valued at more than $25 to fail to provide consumers with disclosures regarding their right to cancel the sales contract within three business days of the transaction. It has nothing at all to do with online sales. Too bad your bachelor's degree didn't teach you that, honey.

PayPal disputes always have been for ‘not as described’ issues only. They never handled ‘change of mind’ situations.
Regardless of a seller’s return policy … you can still file a PayPal dispute when the item is NAD in some way.
The problem you’re having is that this is NOT a NAD situation so your only recourse is with the seller directly.

·3 years agoebay buyers are well protected by the money back guarantee or MBG
its always best to just use the MBG and skip the back and forth with the seller
ebay prefers that you use the protection that they offer and so does paypal
if you open up a paypal claim then you cant open up an ebay claim later
in short, use the MBG first and then use paypal as a last resort

OP3 years agoObviously it's been a while since you've been on PayPal with a dispute and they said that they don't deal with disputes from eBay they want you to go to eBay and settle it so think about that in the future

What dispute? Making a mistake by ordering the wrong color is not disputable. Who would you file a dispute against since it is not the fault of the seller or Ebay?

OP3 years agoMadonna having been a Salesman for 15 years every customer has a certain amount of days to return the item purchased without there being anything wrong with the price the color or size. Was in a certain amount of days of the purchase the customer does not need a reason except that they do not want it. That's not a dispute it's all right

As the previous response said, ebay's money back guarantee (MBG) protections work for up to 30 days after an item has been delivered, for not as described issues. You have 30 days from the last estimated delivery date if an item has not arrived. PayPal wants you to go through ebay first, then they will assist you, for up to 180 days from the date you paid.

OP3 years agoHey Mike eBay won't even talk to you until after you receive the package my point was I was calling the seller trying to catch him before the mailed it and whether or not he mailed it still catching it less than 48 hours after purchasing it I indicated that I wanted to change my mind which I think should be in the American buy and sell system okay 48 hours or less give me a break and I said I will pay for shipping back to you if you give me credit so I'm waiting for a response

No returns does not mean no refunds. Buyers have eBays Money Back Guarantee Money Back Guarantee
It works well if used correctly, buyers have 30 days from the last day of delivery to open and Item not Received case.
Buyers have 30 days from date of receipt to open a return for didn’t like it , not as described, missing pieces, etc.
If after opening a case and the seller doesn’t respond within 2-3 days you can get eBay to step in for a refund and the seller gets a defect against their account, too many of those they are done selling on eBay.
Just because a seller says no returns doesn’t mean you can’t return it.

OP3 years agoJust so you know and others please read this I already contacted the seller and indicated to him that I didn't want those and I wanted the solid blue he said that because he had already shipped it that I would have to talk to PayPal and PayPal wants you to wait 7 days or some crap before they do anything
So I wrote the seller back and said I will pay for shipping back to you if you will give me credit so now I'm waiting for a response
You don’t need to talk to Paypal, PayPal won’t even get involved until you work through eBay first. You don’t need to talk to the seller anymore either When you do receive item you don’t want Please use the tools eBay gives buyers to open a return by clicking RETURN THIS ITEM next to your item in your purchase history. Chose the option that best fits the reason you want to return. If it’s wrong color you will be paying for the return, if the item is not as described, the seller pays. If you pay the return and the seller receives it he has 2 or 3 days to issue a refund. If not you can have eBay step in to force a refund.
Talking to a seller through messages is NOT how to get your money refunded. The seller will more than likely just string you along until you run out of time for the money back guarantee. But hey you asked for advice here if you decide you don’t want to accept it, it’s entirely up to you.

·3 years agoIt doesn't matter which color you WANTED, it matters what color you ORDERED. The Money Back Guarantee only covers items not received or that were not as described (again, not the same thing as what you wanted or expected).
"BASIC CONSUMER 30 DAY PROTECTION" does NOT cover your own errors, changes of mind, buyer's remorse, etc.

Why would a buyer make that kind of an offer to the seller when he can use the Money Back Guarantee?

·3 years agoJust because a seller says no returns doesn’t mean you can’t return it.
But the seller may not pay for the return, meaning the buyer can keep or discard it. Or send it back on the buyer's own dime.
What a seller cannot refuse is a refund.
