I received the heavily damaged pakage with marked "RECEIVED WITHOUT CONTENTS AT" on the pakage. I immediately contacted seller, seller told me to do a usps claim myself.
At that moment, I felt concern but followed seller instruction to file a claim, however, I found out that only seller can file the usps insurance claim under ebay policy.
I immediately called ebay customer sevices, they opened the return case for me and instruct me to send back the empty-damage package to seller. After Ebay agent open the return case, seller yelled at me with message and said my intent is double dipping and said not doing in ebay favor even this is the policy.
Now I do not want to lost my money and also be retaliated by seller or something like this, this is my first time!
Should I follow ebay customer advice and send back the damaged empty package with that marked to the seller? I afraid seller accused me with different thing!

I would just ignore any future messages from the seller and just follow the steps in the return case (which would now only be making sure you check when it’s actually delivered to the seller and that they issue the refund within the 2 days allowed).

Many sellers try to trick buyers to do that.
Once a case is closed it cannot be reopened and your ebay protection is cancelled

·6 months agoYou need to tell the seller that it's on them to file the insurance claim. There is no double dipping. There is an issue which is clearly marked so there is some kind of documentation of issues with the package. Yes print out the return label and return the packaging sent that was broken into and return that to the seller. They will then need to refund you. I would suggest taking photos to have on your end.

·6 months ago@nhanhoangle Sometimes when a box gets damged, the contents get seperated from it. That's why it says it arrived without contents. USPS could not match the contents to the box, so they sent you the empty box instead.
The correct thing to do here is to open a return for the reason MISSING PARTS OR PIECES. When you go into your account and look at the order, does it show that you have an open return? If so, what does it have listed as the return reason? As long as the eBay rep opened it under the correct reason, the seller is responsible for sending you a shipping label.
The seller has 3 days to either a) refund you or b) send you a shipping label. If they do neither of those things, eBay will refund you from the seller's account. I think that refund is an automatic process, but if you do not hear from eBay on the 4th day, then ask them to step in. Otherwise the seller should send you a shipping label by the end of the 3rd day. If you get a shipping label, put the damged box inside a box and ship it along with anything from USPS that says it was damaged.
If you do not see the return was actually opened, then you need to open it. You will open as MISSING PARTS OR PIECES. You will need to take a photo of the damaged box and a photo of anything from USPS that says it arrived without contents. Once you have filed that, again the seller will have 3 days to either refund you or send you a shipping label.
If you end up mailing the damaged box back, make sure you take it to the post office and give it to the clerk. have them hand scan it and get a receipt. Don't just toss it out for the mailman to pick up or place it into a box. The reason for this is becuase should the package never get scanned, it look like you never sent it back. The seller won't have to refund you in that case.
The seller can file a claim with USPS and get their money once they get everything back. Honestly, they can probably file the claim without even having the damaged box as long as you have sent the photos of everything and how it arrived. That's not your responsibility. Just send it back if that is what they want. Once they get it, they will have to refund you in full.
Do not continue to engage with this seller. There is no need for you to do that. Just follow the return process. Also, if you are going to shop on eBay, it is imperative you learn about eBay's Money Back Guarantee so that you don't let scammy and irresponsible sellers walk over you.
Sellers cannot really do anything on the platform to retaliate against buyers so I would not worry about that. We can only leave buyers positive feedback. Sometimes a scummy seller will leave negative comments with the positive feedback. If that happens, you can ask eBay to remove it as that violates policy.

OP6 months agoThank you so much this is very helpful, Ebay agent when called me did open the return case for me that in the category "not as description" so does it affect? Seller keep arguing about the return and since today the 3rd business day, Ebay stepped in and provided me the label

·6 months agoYes, that's fine too. There are several seller-responsible reasons that would work. I just wanted to be sure that's how the opened it and that they actually did open it. So definitely ship it back since you have the label. Make sure you ship it before the date eBay told you and make sure to have the postal clerk scan it and get a receipt. I'm sorry you are having to go through so much trouble. The seller should know their responsibility. It isn't your job to hold their hand.
