Package delivered at wrong address
A seller send my package at the wrong address.
The company says delivered and there is a picture of the package put on the floor at an unknown address.
My delivery address is a UPS store with people that gets the package for you. The package has been delivered during working hours so there is no way that package ended-up on the street. Actually that is the reason I am paying an expensive service to get my packages so I don't have to worry having the package left on the street.
I opened a case with Ebay giving all the information that I am providing right now. I called the delivery company and they told me by phone that the address of delivery is not the address I provided. I asked the seller to contact the company which he didn't do.
Actually there is an history on my case where I ask question to the seller and seller never replies but Ebay didn't even care of that.
The seller just said package delivered to Ebay and the case has been closed on his favor without him doing nothing at all to check for a package that he is responsible to deliver.
Ebay abandoned me (the buyer) so I opened a case on Paypal and exactly the same thing happened. Buyer protection ? no!
It is easy for an Ebay seller to ship to the wrong address and go away with it.
I just can't believe with all Ebay years of experience that they still consider that a delivered status means the package has been delivered at the correct address.
I am going be very careful from now on buying from Ebay because sellers bear no responsibility for sending your item to the wrong address and nobody cares from the seller, to Ebay, to Paypal except the buyer (me in that case).
I wonder to how many buyers it happens on Ebay every day.

OP2 years agoFor what it worth I reported the seller on Ebay for not following Ebay policies, that was my last card. I don't believe I am going to be refunded now.

If a seller scammer has changed the shipping address, what makes you think they do not have a bogus ship to / return address? Scammers aren't dumb for the most part after all. So if you file an INAD dispute, and receive a return label it will probably end up being an undeliverable or nonexistent address in their registered zip code, and then a buyer may be the one ebay punishes. If the scammer wanted to add insult to injury, they could even file a claim with the postal inspectors.

·2 years agoIf a seller provides a prepaid return label with an invalid address the buyer will be refunded when it's returned back to the buyer. I've read on many other sites of buyers opening INAD claims with a 100% success rate and they highly recommend doing that over filing an INR. And thinking about a scammer filing a claim with postal inspectors had me lol.

Very simple. One need not use an eBay label. So long as something is delivered (preferably to the buyer's Zipcode) that is all that counts. The street address is not visible online. So, you buy a computer from me, I can use my own label (or alter the eBay label) to ship a box of paper clips to the tavern down the street from you. You file "item not received", I have proof of delivery. You lose, and the Money Back Guarantee won't help you.
Or I can ship it to an 'empty lot' in your area, and it will be returned to sender since the address doesn't exist. eBay then considers that the BUYER did not provide the correct address and will find in favor of the seller.
eBay requires "written proof" from the carrier that the parcel was not intended for nor delivered to the buyer victim. Since this is often impossible to obtain, eBay doesn't have to pay out, the seller can continue with their scamming ways, and the buyer is essentially thrown under the bus because the Money Back Guarantee is a fail.

·2 years agoWow. It wouldn't seem possible to modify an Ebay label, though, because the barcode has info coded into it. I remember selling long enough ago that I would have to get the address from the buyer, then type my own label, but that was a long time ago. I could possibly see just creating a label to a wrong address and then using tracking obtained at the counter from that shipment as proof of delivery, but couldn't Ebay (or the Post Office or other shipping service) tell that the address in that tracking number didn't match with what the buyer provided? It would seem it wouldn't take too much investigation to catch this.

That is always an option: File SNAD, wait for the return label, and use it to satisfy a return. Apparently, it works like a charm.

·2 years agoYes, it's easy when a buyer isn't sure what to do.
As long as tracking shows it was delivered, they will find in favor of the seller, doesn't matter where it was delivered.
You need a letter from the carrier stating that the package with that tracking number was not
addressed to you, but someone else, then use that letter to appeal the case.
Since you already went to Pay Pal, Ebay will no longer be any help.
When you get the letter, use it to appeal the Pay Pal case.

Yes, it pretty much does. It has been going on for years and it is a quite successful scam. See if you can re-open the case at PayPal, and choose "Shipped to wrong address" instead of "item not received". They recently added that option supposedly for this very reason. Your avenues of redress from eBay were closed when you opened a PayPal case.
If you claimed INR with PayPal, all they do is submit the claim to eBay who responds with the same phony delivery confirmation and you lose again. This should be pursued as FRAUD/FAKE TRACKING SCAM, not item not received.
If you paid with a credit card, you can do a chargeback. Do not do this if PayPal will re-open your case. But again you must not simply claim INR...even though you did not get anything and the first logical choice. Scammers know this is the first logical choice, eBay provides no other options, so the scam goes on and on and on ....

It is scary to see the tip of the iceberg for that "seller responsibility" not enforced. I didn't pay with a credit card unfortunately.
Ebay is been clear with me, that I opened the case on Paypal so they won't help (Even if Paypal call them for the case). But why in the world they can't provide me the reason on what ground they gave credit to the seller if I gave them a proof that the delivery address was wrong when the case was still open. Do they even have people in their customer service that deals with shipping issues?
Actually I put the reason "Shipped to wrong address" on Paypal and they told me they contacted Ebay on an Email. And I spent 20 minutes with Ebay customer service just before Paypal contacted them and the Ebay representative told me she would put a note on the issue I pointed on my case. And nothing, nobody checks or put a note, or is professional.
Even the seller had the gut to tell me that any issue, he would check and refund or resend and then nothing. The seller never contacted the delivery company and Ebay and Paypal are fine with it. Nobody keep their words from the Seller to Ebay.
It is just that you have a delivered status then it has been delivered and Ebay and Paypal put the responsibility on the buyer for a wrong delivery address and the seller is not even involved to provide a proof when asked during an opened case on Ebay or Paypal.
What a lame way to deal with a customer issue.
So now I don't have any other options on Paypal to make my claim I don't have an option that fits my scenario. I am just left here, robbed. In the future I will search first on Amazon for common items to buy that are shipped by Amazon. I bet that is safer than risking it on Ebay shady sellers enforced practices.

eBay requires proof from the carrier "in writing" that the parcel was not intended for you/delivered to you. Knowing that this is often impossible to obtain is part of the 'denial process' that eBay uses to deny, deny, and deny again your claim. It works. Either the buyer simply gives up and goes away, or they insist on INR with PayPal and/or their card carrier which doesn't work out well either.
Those that control the money, are in charge of the outcome. Unfortunately, that is NOT you. The same sort of program is worked on sellers who have their paid for returns sent to the local library or gas station to satisfy the eBay bots that a return has been made.
After almost 13 years of this, one would think eBay would be providing a "better buyer experience" for their customers instead of making the Money Back Guarantee void.

OP2 years agoI asked to be contacted by an agent on Paypal using the chat widget. That is what I found on the Paypal chat today:
If you are contacting us regarding the dispute case XXXXXXX filed for item not received. I reviewed the case and see that it is closed in seller favor. The reason why your case was closed, despite not receiving your order, was because of the tracking number your seller provided to us showing valid proof of delivery to the city, state, and zip code that was provided to the seller within the transaction details.
For us to disprove the seller’s tracking number for your case, we’ll need confirmation from the mail carrier(FedEx) stating that no item was delivered to the address. We don’t need to know where the item was delivered to or to whom received it. Just a simple confirmation that nothing under the tracking number of (<XXXXXXXXX>) was delivered to your address.
We can accept this proof in any of the following forms;

Buyers have reported having difficulty obtaining a statement from their local FedEx office. [That probably depends on the particular office.]
I had contacted FedEx at their 800 number (800-463-3339) … and they sent me the statement as an attachment to my personal email without difficulty.
BTW, I don’t think anyone’s pointed out yet on this thread that the scammer isn’t always the seller. In 2 of the several fake tracking scams I was involved in … it was the drop-shipper (or the drop-shipper’s supplier) who perpetrated the scam. The sellers were as victimized as I was.

Thanks for the info, I'll try by phone then. I called Fedex already at that number on June 12 and they confirmed me it was not my address on the label but I didn't know at that time I should have asked for a written confirmation of that. I didn't know that the drop-shipper could be involved in a scam too. My seller was not honest since the start anyway, he didn't contacted Fedex. I believe he was just lazy but I don't know for sure.

I just contacted Fedex, to that phone number (800)463-3339, and I couldn't get a representative because my case was closed already. So I tried that number (877)339-2774 for technical support and I manage to get a real person. That person told me yes it has been delivered to the wrong address and the shipper is Walmart (so that is what it is a drop-shipping scam) and from the seller behavior I believe he is involved. That Fedex representative also told me that unfortunately they don't have the option to send me an email to confirm that it has been shipped to the wrong address. Fedex like Ebay is not doing anything here to prevent that scam that is a shame. It is really easy for the seller to scam people and go away with it on Ebay. I don't remember it was like that before. I believe it is really hurting Ebay's reputation, I don't understand why they don't do nothing about it.
What I would advise to any Ebay buyers is to at least avoid any seller that ships from a place that is too generic. I mean if you look for an item put for sale by many sellers and it comes from the same location i.e. "Located in: Chino, California, United States" well avoid that because it is most likely a scam. Ebay buyers should better go on Amazon and shipped by Amazon or another Ebay seller with unique selling location.

·2 years agoThanks for the update @gabi-tt . I would try phoning FedEx again to see if another rep might be willing to send you the statement that your name and address were NOT on the package with the tracking number you were given.
If you can get FedEx to attach the statement to an email ... you can phone your credit card company, ask to speak to their Fraud Department, and ask them to do a chargeback.
Even if you cannot get a statement from FedEx ... I would STILL contact the Fraud Department of your credit card company and see if they will check with FedEx to verify that your personal information is NOT associated with the tracking number you were given.
Your credit card company is much more likely to provide a refund than eBay ... since you will be speaking to a human in the Fraud Department who is aware of this very common scam.
BTW, sellers using Walmart as their 'drop-shipper' could put a variety of US cities as their Item Location ... not just China, CA.

·2 years agoFirst you have to get a letter, an email will do from UPS saying that package was not delivered to your address. You may have to call more than once as you will get a different rep each time. Some will help others won't.
Then you have to contact eBay and see if they will help. If not, and you paid by credit card contact your card company.
Was it an expensive item? If so, it could be the fake tracking number scam.

OP2 years agoEbay have been cleared that they won't help. They have been unprofessional to handle this case since the start. The item was around $40 so it could have been worse. It is more the feeling of having been robbed and approved by Ebay that is harder to go through. It makes me feel that the platform can not be trust as a buyer. Plus I really can't understand how a company that deals with shipping items issue all day long assume that because there is a delivered status then that is ok there is nothing to complain if the delivery address has been proven wrong.
