Dear eBay Customer Service,
the purchased article was shipped by ebay USA.
In Germany, a parcel may be left at an agreed safe location only where the recipient has authorized such an arrangement. Without such authorization, simply leaving a parcel somewhere and marking it as delivered does not establish that the recipient actually received it. This is punishable by law and not allowed by any circumstances.
I am writing to formally request a full refund for an item I purchased through eBay USA.
According to the tracking information, the package was marked as delivered. However, I did not receive the package. At the stated time of delivery, I was at work and was not at home. I have checked my property and the surrounding area, but the package cannot be found.
I would like to make one important point regarding the alleged delivery.
I did not authorize the carrier to leave the package at an alternative location, in a place accessible to third parties, or otherwise leave the package unattended. I also did not authorize delivery to a neighbor or any other person.
In my case, there was no authorized alternative delivery location and I did not personally receive the package.
I contacted the seller immediately regarding this issue. However, the seller has refused to take any action and has simply referred me back to eBay.
I subsequently opened a case with eBay. Unfortunately, the case was denied, including after I submitted my appeal. I am therefore currently left without both the purchased item and my money.
I respectfully request that eBay reconsider this decision and issue a full refund.
A tracking status stating "delivered" should not be treated as conclusive proof that I received the item, particularly when I was not present at the delivery address and did not authorize the package to be left unattended or at an alternative location.
I therefore ask eBay to review the case again and specifically verify:
Where exactly the package was allegedly delivered;
To whom the package was allegedly handed over;
Whether the carrier has any proof of an actual handover to me or another authorized recipient;
Whether there is any record of an authorized alternative delivery location; and
On what specific evidence eBay based its decision to deny my claim.
If eBay maintains its decision, I request a detailed explanation of the evidence demonstrating that the item was actually received by me or by a person authorized to accept it on my behalf.
I have paid for the item but have not received it. I therefore request a full refund of the purchase price.
Thank you for reviewing this matter again. I hope eBay will resolve this situation fairly and restore the funds for an item that I did not receive.

·1 month agoThe buyer is in charge of delivery instructions with your local postal delivery company. It is not done through the seller or eBay.
Perhaps the item was stolen after it was delivered.

If it was stolen after delivery, that's on you.

·1 month ago@narei_75 I hate to break this to you but your letter to Ebay is meaningless. This is a buyer/seller forum. We answer questions and give advice only here. Ebay representatives are not here. They will not do anything anyway. Once tracking states delivered then they no longer are obligated to issue a refund. You need to contact your payment source. Please also note this is a USA site not Germany. You might get more information how things are done in Germany on a EU site. We only go by USA rules.

the adress was not fully displayed (just the city) and paypal germany refunded my money.

·1 month agoAnother difference from what would have happened if you were in the US.
In the US, PayPal would have stated that they defer to Ebay's previous decision.
You would then need to see if your payment method would consider the dispute.

Postal regulations vary country to country, you may be able to request that a delivery be made to a location on your property in Germany, and Deutsche post will do that, but that is not always the case here in the U.S..
It sounds like you have been a victim of what we call the Fake tracking scam. Something is sent and the tracking shows delivered someplace within our postal code, but not to the buyer's address. Because of our federal postal privacy regulations it is very difficult to get the actual delivery address of a package not addressed to us. As the previous reply stated you will get better answers to your question if you post it on your home site's community ( www.ebay.de )

If this item was purchased from a seller in Europe, then you should ask about this on the eBay Germany community. The responders there should be familiar with the laws that apply there.
If this item was from a seller outside Europe (such as the USA, where you have asked this question), then European Regulations (for example, the distance selling regulation) do not apply to merchants who are not based in or selling from Europe. When you purchase from a seller outside Europe, you are the importer of record, and issues like this are your liability and responsibility.
This issue appears to be one that you will need to resolve with the shipping carrier. Neither eBay, nor the foreign seller are responsible for this. It is outside the jurisdiction of Europe.
