Need advice on how to get ebay to honor their money back guarantee for non-delivery
I bought some physically small items costing $56 total. The seller provided a false UPS tracking number to me and to ebay. I have a UPS account myself so I was able to call UPS and get the true sender's name and the true name and address for the tracking number provided. They were both not related to my seller nor sent to me at my address. The package also weighted 7.8lbs instead of a few ounces. I reported all of this to ebay and still they closed the case as "delivered". They refuse to reconsider even though I provided them with all of this information. I think only a computer looks at the "Delivered" mark on the tracking number and they do not care that it went somewhere else than to me. Plus the package weighed 7lbs more than my item.
Additionally we live 2 miles from ebay headquarters and we went there last week. I asked to speak to someone in management about this criminal scam. They refused to let me in or speak to anyone. They handed me a form paper to fill out. I did that. They said their "Customer Service" in Utah would get that paper and call me. But that has not happened at all. Since my case was denied and then my appeal was denied within 5 minutes after filing the appeal, I do not know what to do. The police will not assist with my loss of such a small amount.
I have not been able to find a correct legal way to supoena or summon ebay to court. Does anyone know how to file a legal claim against ebay? Given that others besides me have lost money to these criminal because ebay is neither listening to the buyers' reports of fraud nor are they changing their policy to require sellers to send with proof of delivery to a specific address, I think a Judge should order them to shut down these illegal practices and fine them for allowing it to continue.

This is NOT an eBay scam. I have encountered it when purchasing items on eBay, Amazon and Home Depot ... that were shipped via USPS, UPS, and FedEx. The source of the scam did NOT appear to be the individual seller ... but rather the DROP-SHIPPER or their SUPPLIER.
It was easiest for me dealing with Amazon ... at the time ... since their CS rep was able to phone UPS while I was on the phone and refunded me immediately. [Amazon's reps can no longer be reached easily, unfortunately, and they no longer are based in the US.]
I was able to get refunds on ALL my 'false tracking number scammed' items. With eBay ... you can send your UPS report to the reps on social media, which DO have familiarity with this scam. OR you can handle it in the Appeal ... after losing the INR case.
There is no way to 'file a legal claim' on eBay ... since we all agreed to use arbitration to handle disputes when we joined eBay.

·3 years agoI guess if you tried everything with eBay on a refund...and I say everything. Then just go online with your debit or bank institution and file a dispute. Refund usually in 2 weeks. It seems you spent a lot of time with this and all you had to do was file a dispute with your card online. I find it quicker and easier to do it online than by phone or in person(your bank).

·3 years agoCan you secure a written statement from UPS confirming that the tracking number of that parcel was not delivered to your address & then provide it to ebay in an appeal for reconsideration.
If you are not successful with ebay, if your payment was by PayPal, file a case & submit your documentation.
As a last resort if your payment was by credit card file a dispute.

OP3 years agoI looked at the local BBB about ebay and found this:
ebay has given a BBB rating of A+. That is not justified given there are 992 customer reviews and the sum total rating is 1 star.
Then I looked at the number of claims filed against ebay on BBB and see that there were 13,306 complaints filed against ebay in the past 3 years.
I filed a report anyway.

·3 years agoThe deal is when you filed not received you needed to have immediately called eBay and told them the tracking is not to your address and you have proof of that from UPS, and ask them where to fax the letter from UPS and the police report.
Contact them on Facebook eBay for Business or twitter.com/askebay and see if they would reconsider the appeal.
There's no way I'd take the seller to small claims court over $56. Your time must be more valuable than that. Especially when you must file in their jurisdiction and they can jerk you around and get the case continued several times.

·3 years agoGet a letter from UPS stating that the package with that tracking number was not addressed to you, file mail fraud with USPS and a police report.
Once you have all that, use them to appeal the case.

You did not read my post carefully. This transaction had nothing at all to do with the USPS so it is not mail fraud.
The police department here will net even take a report for less than $1000 loss.
