Item Not Received now Seller Wants To Ship
I won an auction for a watch on July 10 and item was to arrive by July 15-19th. I sent a couple of messages to the seller asking if the item had shipped and got no response. No tracking number supplied. On July 20 I sent another inquiry and got no response. On July 22 I filed an INR and checked refund requested since I had purchased another watch elsewhere. Today I finally get a response from seller saying "will mail item today". Do I have to accept the item now or can I demand a refund?

You have been using ebay long enough to know to check each seller's feedback profile before buying from one. It looks like your very new seller had received a negative before you made your purchase for not shipping. Because of that and the fact that they are new, ebay placed their hold on the seller's payments again, and they may not have understood why since the hold had been lifted already. They're not the sharpest tack in the box, as evidenced by them listing auctions with very low starting prices and not getting many bids.
If the seller uploaded tracking yesterday, or posts it today, and you refuse the package, you may lose the dispute. You could always accept it, then sell it yourself and probably get a better price for it.

·2 years agoNo, you don't have to accept the item. It's very possible the seller is trying to string you along past the deadline to ask eBay to step in. Don't let them. On day 4 go back to your case and ask eBay to step in. If the item comes after you've been refunded you can simply refuse delivery. If it comes before you've been refunded you'll need to accept the package and open a return case.

·2 years agoWas the seller on "Time Away" or has an extended time for shipping? Check that first.
Item will list "estimated date of delivery" under the auction...not talking about tracking.
You can file an INR one day later of 'estimated date of delivery'...not before.
The tracking has no importance other than it being mailed.
I don't use tracking on everything.
