Item not received help please a seller is trying to scam me!
Hi all,
I need urgent help, I purchased an item for $500. The seller added the tracking number and it showed as delivered but I did not received anything, when checking the delivery address it shows a completely different shipping address not even in the same state where I am.
I asked the seller for a full refund but they opened a return request and asked me to accept a partial refund of $20...
I declined the partial refund but now there is a return request open but I can't return something that I have not received and I can't ask ebay to intervene as the option is gone.
I want to close the return request but I'm not sure 100% how to proceed, should I cancel the return request?
Will I be able to request ebay to intervene if I cancel the return?
What should I do please!

OP2 years agoHow can I open a dispute case?
Since the seller added a false tracking number that shows as delivered the option to ask for a refund in the "More actions" button is not there anymore!

" I did not received anything, when checking the delivery address it shows a completely different shipping address not even in the same state where I am".
Did your seller upload a tracking number to the order when they shipped it? If they did, when you open an item not received dispute, eBay's automated system can only look for at the tracking for a Delivered scan. When it sees one it closes the dispute in favor of the seller. If the seller did not add a tracking number to the order they will have to provide one in the dispute. If they only added one to an ebay message, ebay will not look there for it. You can use the Ask eBay to step in button in your dispute, which should be just above your purchase history.
If they did upload a tracking number, and the dispute is closed in favor of the seller, A note to that affect will be in the dispute you filed along with an appeal button. All you have to do in that case is to click on the appeal, then write in The tracking information shows this package was delivered to City, State, zip code, which is not the address in my order details. A real person can check that info and will reverse the original decision issuing you a full refund.

@ticotrading506
At this point, NO.
Actually, chances are real good if you had filed an "item not received" claim, you would have lost due to there being a recorded 'delivery confirmation' associated with the transaction.
Has your seller provided you with a "return label"? If they don't do so after three days, return to the case and ask eBay to step in (escalate the case). That should initiate your refund.
If you get a return label, make a copy of it the said label (for your records), then attach one to a parcel containing exactly what your received i.e. NOTHING and send it on. If it was an international seller, they are supposed to SEND YOU MONEY IN ADVANCE for return shipping with d/confirmation. Agree to nothing else.
If you close a return case, it will end any issue or assistance you have with eBay in favor of the seller. A buyer can change an item not received claim to a "not as described" claim, but not the other way around.
You are presently participating in a procedure that is run by a bot. The customer service that you get via a call back or chat are more than likely not able to help you (they will tell you they will, but don't count on it).
Another alternative would be to file a claim with PayPal for "SHIPPED TO WRONG ADDRESS". Your eBay claim will be automatically closed, so you may want to wait on that.
Or, if you paid with a credit card, you can do a chargeback (again, not at the same time that your eBay case, or PayPal case is still open. Make sure you file under FRAUD/Fake Tracking Scam, not "item not received". If you file INR, the card company will submit the claim to eBay who responds with the same phony tracking/delivery information and you will most likely lose the case and your money.

·2 years agoThe seller couldn't start a return, only the buyer can do that.
You need to get a letter from the carrier stating that the package was not addressed to you, then use it to try to get your refund.
