Item not received and case closed by eBay
Hello,
I would appreciate some advice. I don’t want to make any false accusations – I’m just trying to understand whether the tracking provided is considered valid proof of shipment.
I purchased an item on January 4th. The seller marked it as shipped without tracking on January 6th, with an estimated delivery date of January 12–17. The item never arrived.
I opened an item not received case on January 26th. On the same day, the seller added a Deutsche Post tracking number for the first time.
The tracking status currently shows:
“Status offen – Wir erwarten Ihre Sendungsdaten in Kürzeâ€,
which appears to mean that Deutsche Post is still waiting for the shipment data and that there are no information about it. There is no sign of movement.
The case was closed today in the seller’s favor as he opened his case where he told that he has shipped the item. A tracking number exists, but I’m unsure if this status actually confirms that the item was shipped, and I have no idea why it was added 3 weeks after my payment.
Any guidance would be greatly appreciated. Thank you.

OP8 months agoThanks for your advice guys. What would you suggest to do? Should I appeal to eBay’s decision of not giving me refund?

Typically when an item not received case is decided in the seller's favor eBay will communicate the tracking showing delivery in the case decision. That tracking should show delivery to your city for eBay to have decided the case against you. If it doesn't then I certainly would appeal the decision. I'm concerned the seller may have given eBay another tracking number and you may be the victim of the fake tracking scam.

Your seller is in Germany, and you're in Poland. I can only speak to the way things work here in the US.
A tracking number alone, being created doesn't count as being shipped - it's only been shipped when tracking shows that it's in possession of the the shipping carrier. I once purchased an item from a military collector in the Netherlands, and experienced a situation similar to yours. I received a tracking number with no updates, and almost 2 months later it was delivered to me.

For a seller to win an INR case, they need tracking that shows it was delivered.
