item not arrived and ebay says I don't have protection anymore
On 12 Feb I placed an Order for a surface laptop 3 the price was so and it was gold color which I liked so much anyways after payment seller sent me a message asking for address it was weird I had over 200 orders and no asked for address its clear one I place an order its should show for the seller as my shipping address is in US,
the was estimated to be delivered on 18 FEB then changed to 22 Feb since fedex weather delay then changed to cant deliver item is damaged
during 22 Feb and 15 March I asked the seller like 5 times to do something about it maybe it was only the box damaged not the laptop since it was hard to find for this price but he didn't do anything about it blaming it on fedex 15 March I asked seller again to check if its not damaged and gave him deadline to be 20 March
still no respond even though the seller had 100% feedback I feel like he scammed me on 21 March I opened a case asking for a full refund seller said my address was wrong I don't if the seller is blind because its clear by tracking saying it was unable to deliver because its damaged after on 24 March I contacted ebay they said I have lost my ebay protection and they can't do anything about it according to ebay policy 30 calendar days after estimated delivery date which for me 22 Feb and I reported on 21 March which only 27 days Later I contacted ebay again on 27 March they said because it was 18 Feb at first and then changed 22 Feb which is slightly higher the original delivery date I have to wait for 3-7 days more Now I have doubts after being ebay member for more than 8 months can ebay really protect buyers ? why should I pay something that I never received I know that I opened the case late due to my credit card was so lost I was waiting to find my card I don't know what to do now ?? any suggestions

You paid.
The seller shipped with tracking using FedEx.
The last estimated date for delivery was 2/18 but changed to 2/22 due to weather.
FedEx damaged the shipment and will not deliver it to you.
You have been asking the seller to resend the shipment.
He blamed"it" on FedEx.
It is possible that the damaged laptop has not yet been returned to the seller, since shippers do not make that sort of return a priority.
Sellers are loathe to make refunds without the return of the disputed item.
You have 30 days from the last estimated date for delivery to open an eBay Not Received Claim.
That deadline was March 20.
February had only 28 days.
You are also covered by the Paypal Buyer Protection program for 180 days from payment, if you used PP for payment.
You are also covered by the chargeback provisions of your credit card, if you used that for payment either through PP or alone.
You cannot claim a refund on payments made by gift cards.
You probably cannot claim a refund on payments made by debit cards/e-checks.

I don't understand why the loss of a piece of plastic has anything to do with getting a refund.
All the information about the transaction was with eBay. The credit card number would not be needed.
The credit card number would also be on your cc monthly statement.
The best thing to do with a "lost" credit card is to cancel it immediately in case someone tries to use it. This is even more important if your card has a "tap" feature.

·3 years agoPer eBay's Money Back Guarantee for buyers, you had 30 days to open an item not received case with eBay if you hadn't received your order by 24 hours after the last estimated delivery date as seen in the listing. Apparently, this did not happen.
Paypal, if that's how you paid, gives you 180 days to open an INR case.
Last chance: most credit cards give at least 90 days to open a case (and some are longer than that) for item not received.
And just curious: Why would you need to find your credit card to open an INR case with eBay?

·3 years agoDid you open a case through eBays Money Back or just messaged the seller?
The only option at this point might be to open a charge back for item not received with your credit card. I don't know how it would work with a new card number, you might try contacting the card issuer customer service.
Because these are buyer/sellers forums, we cannot see what you bought, only offer suggestions.
PS Did you report the card lost or stolen?
That might affect how things go. Don't know.
