Item I bought has been stuck in New York Customs for two weeks. Need advice on next steps. | Buying

Hello, I recently bought an item that is in transit from Luxembourg to California. The last scan received was on September 30th, where the item was processed and received at the Jamaica, New York International Distribution Center. Today marks two weeks since that last scan. I'm aware that sometimes packages can take a couple weeks to clear from Customs, but I wanted to see who would be responsible in the case that the item continues to not move and isn't delivered by the estimated date on eBay - would it be me the buyer, or the seller that takes responsibility? The estimated delivery date is October 24th on eBay, so I still have time to wait, but should I open up a case with eBay if it doesn't deliver past the 24th? Thanks.
