Is Ebay a racketeering enterprise?
I purchased an item at the seller's asking price. I got a notice from the seller stating their intention to not ship. The seller stated they had decided they wanted more money for the item. They stated they advised Ebay and that Ebay told the seller they had no problem with the seller not performing and shipping to me. Ebay , per seller, had no problem with the seller relisting the item I had already purchased, in a new listing on Ebay and not performing the sale or shipping to me. Per seller, Ebay advised him to offer the item to me at the new higher price on his new listing which would have required me to buy the item twice and hopefully get it sent to me once, then try to garner my purchase monies back for non-receipt of the item I had recieved on the second purchase? I opted to tell Ebay to review their own records to verify the seller's breach and give me my money back. Ebay has moved their "delivery date" twice now for the item they conclusively know is not ever going to be sent to me. The seller, on the Ebay website, admitted his relisting and intention to not refund. Ebay, on it's website acknowledges the non-shipment and relisting. So where is my money? Where is the DOJ when you need them? This action by the seller and EBay constitute the operation of Ebay as a "Criminal Enterprise" being operated by and through racketeering. The predicate offense is "Wire Fraud".

·8 months agoYes; ebay has been in business over 30 years selling $Billions per year all under the nose of every human on the planet as really a 'criminal enterprise'.

Everything you wrote prefacing it as "Per seller" about what ebay supposedly told them, were lies.
eBay cannot force sellers to ship items, but if they do not ship one all you have to do is file a dispute with ebay.
Go to your Order Details look for the last estimated delivery date there, it wil show you the date you should receive your item from the day you bought it.
One day after that date, go to your purchase history, click on the More Actions button, then on Return item, which will open a menu, select I haven't received it, and follow through to file a dispute. Which will show up under Returns on your My ebay page. The seller will have 3 days to respond by either providing tracking showing it is in the hands of the shipper, or issuing you a refund. If they do not respond or tell you more lies, on day four open the dispute and click on the Ask ebay to step in button. They will issue you a full refund from the seller's account.
All of the actions you need to take can be found by reading the terms of ebay's Money Back Guarantee (MBG). There is a link to the policy on every listing page. Look under the accepted payment Icons for the" Shop with confidence header. Under it is; eBay Money Back Guarantee, below it "get the item you ordered or get your money back Learn more. Click on Learn more to read the terms and time frames of the MBG.

·8 months agoPerhaps someday eBay will decide to more strongly act against sellers engaging in inappropriate behavior that likely tends to discourage some folks to shop on ebay
Have a great day.

·8 months agoThe seller is breaking the contract they had with you so I am unsure why an Ebay representative would tell them that other than they are agreeing with them to get off the phone or they are making up a story. Anyways just file a "Item not received" case 1 day after the estimated delivery date. Ebay isn't operating a "Criminal Enterprise." Ebay just has some sellers who don't follow through with the transaction and those sellers eventually get banned for this behavior. You have rights and you will be eligible for a refund.

This story is very unlikely...i think the seller made it up. That being said, there are many good options posted here for you to follow. Disengage with the "bad" seller. (You can report seller to ebay, that may make you feel better).

Very funny, but A+ for drama.

·8 months agoThat part about the seller having notified eBay and eBay telling him to buy it at the new higher price is questionable, although CS reps have been known to tell people what they want to hear.
eBay's Money Back Guarantee for buyers offers very good protection for situations like this. If you've not read it, now would be a good time.
We honestly hope that you won't encounter such a problem again; however, wouldn't it be a good idea to equip yourself with the tools to resolve it in short order?

·8 months ago@jjaacck-59 This is not some big conspiracy. No need for the DOJ, the FBI, the CIA, or whatever letters you want to toss together. eBay isn't a "criminal enterprise." Your estimated delivery dates were likely moved by USPS (or by eBay in response to USPS) due to the weather. Many areas that have been impacted the past two weeks are not getting mail service, and this has created a backlog of packages at USPS distribution centers. You still have hundreds of thousands of people without power from last weekend's storm, now another big one on top of it.
When the last delivery date that was shown to you when you ordered has passed, open an Item Not Received claim. If the seller does not respond to the claim within 3 days, on the 4th day go back to the claim and ask eBay to step in.

Look in your purchase history for the estimated delivery date.
A day after that date, open an INR for a refund.

·8 months agoYou just ran into a bad seller. You will get to file an item not received case. They will in some cases move the delivery date but that has it's limits. Was it a new seller? They don't always know the rules.

·8 months agoEasy...
Request a refund on 'estimated date of delivery' when it is not delivered.
No need to email(s) seller.

·8 months agoJust open a dispute with your credit card issuer.
No reason to wait for a crooked seller or the Ebay automated process to work its course.
Your seller will either quickly refund or see Ebay keep their fees and charge them an extra $20 when your credit card issuer rules against them.
