I think I purchased a fake

Hi everyone,
I stupidly purchased some loops experience 2 earplugs from an eBay seller, it's been 5 days and all they've done is create a delivery label, postage says it will be 11th August we are in the same state, I checked their pic against the loops website and the pics are different but the eBay pic is the same as AliExpress, so I think they've ordered them from China and will swap the packaging and send them on hence the long delivery times, I've asked to cancel as they will obviously be fakes, am within in my rights to do this?

First of all your profile shows that you are registered in Australia. However, you have posted your concern on ebay's U.S. based site ebay.com. You may get more accurate answers if you post about your issue on your home site's community www.ebay.com.au
In looking at your profile I see that the last seller you received feedback from has not sold anything in over a year. That means that ebay placed a 30 day hold on their payments and your seller may not have known that would happen or how to deal with it, to complete the transaction and get the funds released. All they see on their account is that the payment status shows Pending/Processing and that is why they haven't shipped it. If the last feedback you received is from that seller, and you want the item. Message them and tell them to do an online search for "Transaction holds, ebay"
As for the possibility of the earplugs being fakes, the only way you would know that for sure is when you receive them. Several companies use different packaging for items that are sold in different countries or regions. If those items are supposed to come with a Mfr's. warranty fill out the form or register them online and the Company will tell you if they're real or not. If there's no warranty form/or site to register them on, they are probably fakes, and you can use ebay's Money Back Guarantee to file a not as described dispute (link below). Go to your purchase history and click on the More actions button to start.

·2 weeks ago · Edited@superstar03 Before accusing the seller, have you looked at their handling time? Before you ordered, you would have seen the estimated delivery date. I presume you were okay with that since you ordered.

OP2 weeks agoTrue but I assumed they are genuine, I asked several times and the seller has sorted around the question, unfortunately I had already paid for them, then I did some more digging, plus unloaded each pic to grok, both of us come to the conclusion they are probably fakes, the delivery times I can handle but if they are fakes then I don't want them.

You can certainly request a cancellation, but since all cancellation requests are at the sole discretion of the seller there's a good chance it will be denied. If so, you can use the time waiting for them to arrive learning how to use eBay's Money Back Guarantee to return them for a refund.

·2 weeks agoIt's not an either/or. Reading the Money Back Guarantee will tell you the procedure for doing that.

·2 weeks agoletting ebay know they are fakes will do nothing for you. When you get them and they prove to be fakes you must file a "not as described" return to start the process to get your refund. You can then report the seller for fakes but that will do nothing to get your refund.
