I did not receive my entire order. Do I need to send the stuff I got back after the INR refund?
This is a long one so please bear with me.
I purchased a collection of items for over $1,000 from an international seller. I’m from the USA. Seller has 100% feedback and has been around for over 5 years. They have less than 20 sales.
Package is shipped on 3/28. On 4/3 the tracking shows the package is awaiting pickup at the same post office the seller dropped off at. The package is signed off and picked up by the seller on 4/10. I obtained a signature release form from their post office that confirms this. This happened before the hold period was
even over. Tracking is updated and marked as delivered on 4/10 on eBay.
Seller tells me the package was rejected from customs due to its size and they’ll reship. However, the tracking does not show it even made to customs. Also, there was no notification that I had to pay any duties or fees.
On 4/21 I opened an INR case, because I was not provided with any new tracking information.
On 4/22 the seller tells me they are reshipping the item in three smaller boxes. This item can be broken down into smaller boxes. I was provided tracking for only one box. This gets delivered on 5/2. This box does not contain all the items. The other two boxes never made it (probably never shipped) and I still do not have tracking for them. The seller also changed their story to only ever sending two packages.
I told the seller as long as I get my order I can close the case. After the package arrives on 5/2 the seller tells me he no longer wants to go through with the transaction, and wants me to return everything I received at my expense. I had already opened the package because I was assured I was getting the rest of the stuff, so I am unable to refuse it. It would cost me over $150 to reship. There's an ongoing INR case, so I cannot open a return request. I ask for a prepaid return label. Seller refuses.
I’ll also add that I found the seller sold this same exact item to another buyer via auction a couple days before I did a BIN. Auction went for roughly 25% of the FMV. Listing used the same photos and everything. Buyer left them positive feedback. This is a unique item and it is impossible for them to have multiple. My guess is the seller rerouted the original package and shipped the rest of the stuff to this other buyer.
eBay decides the INR case in the seller’s favor on 5/4. Their reason is that there was an attempt of delivery at my address and I had an opportunity to pick the package up. Per the customer service agent instructions I appealed the case under the reason “I did not receive my entire order†and eBay reversed the decision on 5/7. eBay stated the reason was that the seller agreed to a refund, but never issued it.
The seller threaten to send me to collections and call the police for theft because I was granted a full refund while I still have this package. Also, they said they talked to eBay and they will reverse the refund if I don’t send it back. Is there merit to this? From the research I’ve done it seems eBay is unable to reverse refunds or recharge the buyer. However, the seller can file an appeal and if eBay finds they acted in good faith can do a courtesy refund from their own pocket. I have no problem sending it back, but do not want to pay to reship.
Any help would be appreciated.

·1 year agoAppreciate the story last year Jun 2 bought an item from power rangers zeo it was shipped for days and weeks and never arrived somehow the seller never send it what l paid for complain several times and no response and everything else tried request waiting for weeks and months later when it's August never came never answered also didn't get my money back every single seller next time they should be professional and do what's best when we buy we wanted ebay take action if this happens again next time see what most of u people do also as for Aug 21 we buy a gundam model kit never showed same here this is all l know some of u had a bad day no one's fault let me know later.

·1 year agoI will be contacting Ohio police department for stolen goods and will be reporting this to ebay that you are scamming many people and refuse to return my items and have blocked me and made no initial attempt to return anything that was sent

If you want the items back, you need to pay for return shipping. You can't make the buyer return it at her expense.

But you're right; it has nothing to do with the issue other than that the seller is making a claim about something that doesn't appear to have happened.

This paragraph confuses me.
Are you saying that the item was shipped on March 28 and the seller used their own address as the "ship to" address on the label?
That's odd and suss!
Is there a size limit for international shipments?
How could it be rejected by customs if it never made it into the US and delivery was back to the seller in Canada?
If you only received some of the items in the lot, you need to open a NAD (not as described) case and choose "missing pieces" as the reason.
As for the other 2 boxes that the seller claims to have shipped, if they used the same label (made copies of it) and shipped 3 items with one tracking number, that's a huge problem for the seller and she'll be backcharged for that. (But that's not your problem.)
If the seller wants the items back, they need to pay for return shipping.
you are NOT responsible for paying for return shipping. Don't let the seller bully you.

·1 year agoWhere is seller and item located. You should become familiar with international transaction, currently you are limited to a maximum of$800 daily, depending on item country of origin. At some point in listing or paying you were certainly prompted on duties.

·1 year agoThat's totally irrelevant. The OP then states the package was rejected by customs for being too large, a fact confirmed in post #4, which appears to have been made by the seller. OP was refunded by eBay, so the only remaining issue is the seller's threats if the OP doesn't return the items they did receive at their expense.

Are we to assume you're the seller? I do believe it's not the buyer who has their "head up their bim". As we told @collector_1988 you're responsible for paying return shipping if you want the items back. Them's the rules. If you do indeed have a home in the US you'll be able to send the buyer a return shipping label to the US address. As for filing a police report, lots of luck with that. They'll tell you it's a civil matter.

·1 year agoDefinitely not since he technically is stealing Ohio police department stated they will go down and ask them to return if not i can file charges for theft !!! Because he hasn't paid for such items and refuses to return or work with me !! But yea hope he enjoyed what comes next he blocked me on platforms after the transaction and refused to work with me so yes I will be pressing charges for theft after he intentionally scammed me refused to talk to me thru any period of time during the order / sale so he's very sus im sure he does this with every seller

·1 year agoOh I'm sure the "Ohio police department" is going to "go down and ask them to return". 😅😂😄 I do hope you realize that your accusations that the OP is intentionally scamming you can open you up to libel charges. You've been told what you need to do to get your items back: send the OP a return shipping label. It's quite simple. If you insist on complicating it, that's on you.

I actually had the second box returned after you put in a INR request days after you had 0 communication with me never answered any of my messages never even messaged me about this issue you went straight to ebay without even talking to me or asking me what's going on !! Item made it to Richmond custom port prior to return due to size i then shipped in 2 boxes one which you got which i want a return on and the second which just got back into my possession thank God as my ebay account took a hit over negative 1365$ because of you that I have to pay back some how you screwed me and probably do the same to many others !!! And as for the previous post of my game collection the seller backed out so I relisted the items and then you Bought it had you been patient and not had your head up your bim you would have received the entire package!!! I am still waiting for a return 2 months after this transaction was made !!! I expect a return and since I'm duel citizen I can file a police report if it's not returned to me since I own a home in the usa

The seller is blowing smoke. EBay has no mechanism to reverse a refund. As for sending it to collections or calling the police, both are laughable, particularly since the seller isn't in the US.
Since the seller is international they can't send a return label. Get an exact quote on how much it will cost to return the items you received. Then message the seller and tell them that when they send you that amount you'll be happy to return the items. That's what eBay would have required had you won a 'missing parts or pieces' return.

The moral thing to do is send it back.
Tell the seller if they want it back, they can send you a label to return it.
