How can i create a Item Not Receive Case when Request Return case in Progress
Hi,
I have an order initiated a return request due to the fraudulent listing of the seller ( i checked the feedback from other sellers and realized the seller is a scammer). The goods had tracking but not be shipped (there is no other action listed on tracking details. Ebay stepped in but required me to return the item but i didnot received it. The estimated date of delivery has passed and i wanted to file a item not received case but didnot find where to start. Could you please show me how to claim in this case to get my money back ? Thank you

If i close the item didnot match description case, can I create a new item not received case ?
If not, do I have to follow the item didnot match description case and return an empty item back ?

·7 months agoSimple question, simple answer ... No.
You need to listen to what the experts are telling you - You can't return something nor can you claim it's a fraud if you never received anything.
Looks like you're pooched here. If you have based your actions on 'other seller's feedback', I assume you placed the order before vetting the seller. Perhaps you should have read the feedback first. Good luck ... hope you have a good outcome.

·7 months agoYou made a purchase, did not receive the item and opened Return case.
1st you can open return case at any time because tracking does not always update right away or some sellers ship without tracking.
2nd you can only open not received case if estimated delivery time passed.
3rd if you cannot open item not received - do not open anything else.
4rth you can close this now and try your bank or contact customer support and explain the situation, maybe they will offer a solution, maybe not.

No, you can't open another case.
Do you not understand that having opened a not as described case implies you received it so opening a INR (item not received) case tells ebay that you are lying.
Doing that isn't honest and puts your account at risk should ebay see what you're doing.

·7 months agoYou have requested a return on an item you have not received yet and now want to say it's not as described, which you don't know yet because you haven't gotten it, and blame it all on a fraudulent listing in the first place?

OP7 months agoI read feedback on them item of buyer like me place the same item. It 's a fradulent listing and i want to terminate it early. I need a solution here, not the reason why

·7 months agoYou don't request a cancellation if/when an item does not match the description.
A cancellation BTW can be requested by the buyer before the item is shipped, but there is no eBay requirement that the seller agree to cancel. Most sellers will do so, however, in order to avoid an NAD case when the item is received by the buyer.
And you can't open an NAD case until/unless you have received the item.
If/when you have not received the item, you have 30 days to open an INR case.
So it just might be possible that you need to re-read the MBG .

OP7 months agoThanks, i have read it. But in my case, i raise a Cancel request on item didnot match description first when the goods have not been shipped. Now after the scheduled shipment date passed, i wanted to raise item not received case. Do i have to close the tem didnot match description before ?

·7 months agoBut you didn’t know if they matched the description, because you had not received anything. You should not have opened that return request.

·7 months agoYou can’t. You jumped the gun and started a return request when you could not return anything since you had not received it yet, and you cannot first request a return and then turn around and say you didn’t get it.
You may have recourse through your credit card or whatever payment method you use, if it doesn’t arrive, but I would recommend more patience for now.

OP7 months agoI jumped into raising a cancel request of item not match description due to fraudulent listing . it's weird that ebay allow to do it.
In my case now, should I close the item not match description case to open new Item not received one ?
