How Can A Seller's Legal Name & Address?
I bought boots from a seller on Ebay & I never got them. I have been contacting the seller & Ebay to no avail for weeks. The seller has been very nasty & disrespectful & even had the nerve to accuse me of bullying & EXTORTION. That was the most insulting thing anyone has ever accused me of. How can they say I was trying to extort them for my refund of $50? Who extorts someone for $50? I have all the messages to prove the accusations. I want the legal name & address of the seller to sue them for slander & defamation. I'm also going to sue Ebay for not honoring their 'GUARANTEED REDUND' policy because they have denied a refund several times. I have a right to get my money back. I have been buying from Ebay for years & never had this kind of a problem. I will NEVER but anything from Ebay ever again.

·2 years agoThe simplest way, and the way recommended by eBay's Money Back Guarantee, is to just open an item not as described case within 30 days of receipt of the item.
Did you do that? Have you ever read the MBG?
No one is going to pay you for the seller's insults.

·2 years agoIs this about the last feedback you received? Did, in fact, you give the wrong address? If tracking shows delivered eBay's policy clearly states that you'll lose an item not received case. And yes, if you told the seller you'd give negative feedback if they didn't refund that falls squarely in eBay's definition of feedback extortion.
The user agreement you signed when you opened your account prohibits you from suing eBay. Sure, you can sue the seller. Anyone can sue anyone else for anything. But a judge will laugh you out of court. Both slander and defamation require that 1) a false statement be made publicly (so private messages don't count) and 2) you can prove damages because of the slander. Being nasty and disrespectful is not actionable in any jurisdiction.

OP2 years agoEbay is not the ones accusing me of extortion. There's no such thing as feedback extortion. The seller is the one that accused me of trying to extort him & bullying for my $50 refund. That's not bullying or extortion. That's asking for my hard earned money back. For the record, since you read ONE message, I suggest you read ALL the messages before you respond. The problem was caused by Ebay's customer service. I contacted them & ask wo the carrier would be & I was told it would be delivered more than likely by FedEx so that's why I used a FedEx location. It was delivered to the FedEx location by USPS & it was refused because they don't accept deliveries from USPS at FedEx. Ebay's customer service gave me the wrong information. I had other packages from Ebay sent to that same location, they were also refused but I was refunded for them all except the $50 for the boots. If you don't have positive, helpful advice DON'T RESPOND AGAIN PLEASE. I'M A 70 YEAR OLD WOMAN, NOT A CHILD!!!!!!

·2 years agoThere most certainly is such a thing as feedback extortion. It's outlined in eBay's policy here.
Ebay customer service has no idea what carrier a seller will use, so I'm curious why you asked them instead of just asking the seller? Since you didn't it's certainly not the seller's fault you gave the wrong address. Ebay didn't send packages to any location. Ebay sends nothing. Individual sellers on eBay send those items you've purchased from them. And once tracking shows delivered to the address you gave eBay is never going to force a refund. I'm sorry if that's not as positive and helpful as you'd like. But before you throw money away on lawyers and lawsuits you'll never win, I think it's important to state the truth.
And for the record, I too, am a 70-year-old woman.

·2 years agoThe listing clearly says that the delivery will be by USPS Ground Advantage. I don't know why you would have asked eBay CS about this, since eBay doesn't ship the packages.

A legal claim of slander and/or defamation must include examples which were made public, and not simply private communications between you and the seller -- so there is no legitimate case there.
If the item which you had ordered has passed the posted delivery date, you may officially open up an "item not received" case by following the eBay rules:
1. Go to your "Seller Hub" page.
2. In the upper right corner, click on "My eBay," then scan down to "Purchase History," and click on it.
3. Find the item which you had purchased.
4. On the right-hand column is a series of blue-outlined boxes. Scan under "More actions," and then click on "I didn't receive it."
5. Follow the instructions provided by eBay. In a few days, you should receive your refund.

OP2 years agoThank you for your reply. I want that seller to pay for insulting me. I also have asked Ebay to refund my money several times & they keep denying the request to refund. It seems like Ebay is on the seller's side. I am also going to contact Ebay's headquarters since customer service keeps telling me they don't have any info on how to contact their headquarters but I found the information myself.

·2 years agoEbay will not force the seller to pay you for any "insults" within messages nor will they provide you with the seller's name & address.
According to Ebay's Money Back Guarantee, if tracking does not show the item was delivered, you can file a Refund Request if the estimated date of delivery has passed by at least 1 day.

·2 years agoStop worrying about someone paying for insulting you. It's over, don't communicate with them anymore. You only win by following the actual process for getting a refund, not by communicating with people.
If you found info on how to contact eBay headquarters off the internet, you probably are going to be calling scammers.
Concentrate on getting your money back the right way. Asking eBay for your money won't work. DavyCrockett gave you the step-by-step process for getting your money back. Follow that process only.

OP2 years agoI stopped communicating with the seller because I saw it wasn't getting me any where. I also bought more boots from another place already. I'm getting my money back on my own. I was just shocked of the seller's responses & eBay's response. I'm never ordering from them again.
