I have been an eBay member for 26 years and have a 100% feedback with near 10,000 transactions.
I am recently the victim of a fraud purchase on eBay and I can't get support for eBay's money back guarantee.
On May 10th, I purchased a newly listed pre-owned acoustic guitar. It was a very good price. The seller, though new, had a few transactions with a 100% feedback. So, I thought the risk was small for any fishiness.
However, after I purchased the guitar. The seller relisted the item and changed then quantity available. Then a second listing occurred with a different eBay id but with the same specifics. At this point I emailed eBay that I suspected fraud and provided the item numbers and my reasoning.
eBay responded on the 10th with assurances that I still have protection. I should cancel the order, which I did. And I could open a case if the item I received was not the item I bought.
I cancelled the order, but the seller waited the maximum amount of time before declining the cancellation and providing a tracking number.
On the 16th, I received shipping notification that my item had arrived, but in fact nothing had come to my home. When I checked the delivery picture, the porch pictured was not my home and the package was clearly too small to be a guitar. (See photos below).
I opened a 'item not received case' with eBay. The seller never responded. When the maximum time had passed, I asked eBay to step in.
My case was denied because the package showed successful.
When I call into eBay customer service, the agents are sympathetic. They too can see evidence of fraud through the duplicated listings and a picture and item weight that is clearly not a guitar. One agent I spoke with could even see that the buyer of the 2nd guitar had also reported "item not received"
But I'm in a catch-22. I can show evidence that the item I bought was not a guitar, but I can't open up a return because I never received the item.
I continue to get emails from eBay customer service agents to work back through the seller or to go offline through the shipping company. However, my address is not on the shipping label.
Here are the key factors in the fraud working.
- They listed the item just below the threshold of $750 which would require signature verification.
- They had a few successful transactions on eBay, so eBay paid them right away.
- They slowed the process down.
- They manually uploaded a tracking number and shipped to a different shipping address to show successful delivery to my home city.
- They listed more than one item available below $750 to maximize their robbery of funds.
So, be careful for buying anything less than $750 with eBay if the listing smells fishy.
Thank you,
Alleged delivery of item

Crazy that there are more than one posts about people buying the obvious scam listing.

eBay is awear of these type of scams. The fact that you told them it had happened should have been enough for them to do a more formal investigation then simply view a Tracking Number and dismiss your complaint.

OP4 months agoI did call back eBay and got to their escalation team. They had me do a report suspicious seller form. Like the other agents I've spoke, she too agreed this was fraud and committed to keeping her eye on it. I am supposed to hear back by Tuesday. The sad part is I checked the seller, they have another nice pre-owned Gibson guitar for sell with a quantity of two available. (There's is only the smallest chance you have two of the same exact pre-owned high end guitar available that look exactly alike). One has already sold. 😞
I also called my bank card this morning and opened up a dispute from this direction. I was hoping to get quicker resolution through ebay, but I haven't been successful so far. I can't assume any more that the customer service team, which again have agreed with me, can be successful representing my issue to the back office teams.
It is really painful to try to get through to an agent to talk to someone on an escalated issue. I'm only successful because I know what key words to enter to get the AI bot to offer an agent to contact me.
So far, I think I've spent about 6 hours attempting to get resolution. This time has been made up of typing emails, submitting reports, and talking to customer service agents.

·4 months agoI wish a message could be pinned someplace where buyers would note that if an item they bought states it is delivered but the buyer does not receive it that they MUST FILE A NAD CLAIM. Never file an INR claim as they will always lose that.
We see these fake tracking claims all the time on these boards and ebay is DOING NOTHING to correct a well documented problem.

·4 months agoeBay cannot help you any more. Because you're the scammer now @toddnfamily trying to get 2 refunds.
You should've waited on the eBay case. Good luck with the bank -- that usually works, but it's your last resort.

·4 months agoSorry to tell you this, but, once you pursue a case with your bank card, eBay is out of the picture.

·4 months agoFake tracking scam.
Good luck with eBay, but basically they work with the seller Because if they deny your refund, Seller keeps your money and they keep the ~20% in fees. IE, they get paid to help the seller defraud you.
You should do a credit card chargeback. Explain to them that it was a fake tracking scam. Upload all your evidence (picture of the package, picture of your porch, screenshot/details of the listing describing it as a guitar, any tracking info (weight, dimensions, etc). Call back and VERIFY that they have it described accurately as a fake tracking scam and didn't just put it in as item not delivered.
Again, eBay is WORKING WITH THE SCAMMERS, so you almost certainly will not get a refund from them. They will only work to try and delay you as much as possible.

·4 months agoSee if you can get a letter from the carrier stating the package was not delivered or addressed to you.
Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.
Make a copy of the letter and ship it if they want something returned.
