Ebay will not give me my money back after not receiving item (fake delivery scam)
Bought a pool cue, was immediately told after i bought it that it was s cam as he had fallen for the same item. I tried contacting seller to cancel the order, 5 days later they said they could not cancel as it had already been shipped (on the day they replied to me is when ti was sent so plenty of time to cancel) got a FEDEX tracking number, item desc 18"x15"x14" and 28lbs. Definitely not a pool cue .(I realize the seller can put whatever they want into those descriptions) . I called ebay and informed them of all of this the day I got the tracking number, so everything was noted. Delivery day comes, of course it shows delivered, but only to my zipcode (tracking number did not show up in my fededx dashboard either since it was not sent to my address).
When i was told about the scam by my friend he said they usually use USPS so i was prepared to go there to get the actually address from them, but i got a Fedex tracking number, day of delivery comes, shows delivered, AND signed for by a STALT (not me). SO I did not get the package, I contacted fedex to get proof of delivery but in order to give me proof of delivery I have to give them the address it got sent to. I have them may address and they said that is not the correct address so we cannot give you proof of delivery. I stated I know it is not the correct address because I never got it. So the fact that i cannot get proof of delivery because I cannot very the address should my proof to ebay, but they refuse to give me my $700 even though it was listed an Easy money back guarantee. I am at a loos at what to do here.

·11 months agoContact the Better Business Bureau and open a case with them. All you have to do is explain the situation and upload any supporting documentation. Ebay HAS to reply to the complaint as they are an accredited business with the BBB. I have had to do this a couple of times in the past when Ebay has allowed a buyer to scam me.
Also, if you want to go down a rabbit hole, on the BBB site you can see how many complaints ebay has with them. It's in the thousands.

To the OP: Go to Fed-X. Explain the situation. They know exactly where the item was delivered and it wasn't delivered to your address. They do not have to tell you where it was delivered. Ask for a letter on their letterhead stating that the package was delivered, but not to your address.

The "item not received" case is closed. That is not the only type of case you can pursue.
That leaves you with a "false tracking" claim you can pursue via social media direct message if you can obtain documentation from FedEx, or as a last resort, a "not as described" return you can file through your purchase history.

OP11 months agoOnce again, that is not an option as I cannot get any proof from fedex except for the fact that they wont give me the proof, that is the only 'proof' im able to get is them saying they cant give me proof since i cant verify the address.
Also, once again, i cannot file any sort of not as described on my purchase history as there is no longer an option as eBay states a claim was file and opened and now closed on that item.

·11 months agoI think it is completely acceptable that if the buyer has confirmed with the postal service their item was delivered to a different address, and the seller is refusing to help/answer, then simply open an item not as described case.
If the seller sends a return label, which is doubtful, just send a copy of the postal details showing it was delivered to a different address, or anything else.

OP11 months agoI am unable to get the details of the delivery as i cannot give them the address it was delivered to. Since they have already closed the case i am unable to open another one.

It may help if you go down to a FedEx office in person, with a copy of your order details showing both the tracking number you were given and your shipping address on the same page.
Others have done so, and have gotten documentation. It may be easier or harder depending on who at FedEx you talk to and what you say.

·11 months agoI suggest trying a different FedEx location, or a different shift at the same location. Some employees may be more willing to help than others.
I can only suggest what has worked for others in a similar situation; it may not always work the same way, however.

If the seller is actually a scammer, the scammer is unlikely to provide such a label. Many scammers in that position may offer a partial refund, grudgingly provide a full refund or else do nothing until the buyer asks eBay to step in and forces a full refund.
If the seller is overseas, the seller may not be able to provide a label at all, but may be able to pay for return shipping directly, though if the overseas seller is scammer, the scammer is unlikely to do so.
If the seller is not a scammer, the seller might issue a prepaid return label; if the seller is drop-shipping, and the drop-shipping service is providing false tracking rather than delivering the items, the seller would still be responsible for providing the refund to the buyer.
If the seller is a legitimate seller and the tracking number is the result of a mix-up rather than deliberate fraud, then a buyer returning an empty package or returning a copy of the tracking information may be victimizing an innocent seller by doing so, though technically the seller is still responsible for reimbursing the buyer for the missing package (which only appears to not be missing by virtue of the incorrect tracking information). If the package is missing due to the shipping service's error, the innocent seller will not be able to prove that or collect the insurance for that, however.

If the buyer actually receives something, the buyer can file a "not as described" return within thirty days for a full refund. In fact, any buyer on eBay can file a "not as described" return, provided the buyer is willing and able to return exactly what was received.
If tracking shows delivery but nothing arrives and the buyer can obtain some hard copy documentation (email is not good enough) that says that the package was not delivered to the buyer's address or documentation that shows the weight or size of the package cannot possibly correspond to the ordered item, or the shipping date precedes the order, then the buyer may be able to contact eBay via social media direct message, provide that documentation to eBay and get help with "false tracking".

With "false tracking" if you go through a standard automated "item not received" case, on the other hand, you will lose the case because the seller can provide tracking that appears to show delivery. If you then appeal, you may have some additional options at that point. It appears that eBay has added a new appeal option regarding "delivery to another address", but I do not know how effective that is compared to contacting eBay via social media with documentation and explicitly mentioning "false tracking", which seems to work provided you can obtain the necessary documentation.
If you are unable to get help through eBay, you may have recourse through your payment method, though you should probably exhaust all your eBay options first since once you go through your payment method, eBay will no longer help with that transaction.
In general, you can avoid a lot of headaches by choosing to purchase only from established sellers that have recent and past positive feedback as a seller for selling items in the same category that you intend to buy. If someone is selling a dozen apple watches, but has no feedback, or only has feedback as a buyer, or only has feedback for selling dress patterns or fishing lures (actual examples I have seen), perhaps wait until they have a track record of positive feedback for selling electronics before you buy from them.

OP11 months agoThat's just it, I cannot get hard proof that it got delivered somewhere else, becuase I cannot give them the address it actually got delivered to.. Ebay already had all the notes about the pkg dimensions and how they dont match a pool cue.

·11 months agoYou don't need proof of where it was delivered, but FedEx should be able to give you something stating that it was not delivered to your address (they cannot reveal to you where it was delivered, but you don't need to know that).

·11 months agoIm currently in the same situation, seller from Japan, said the flatware set I purchased was delivered and it was NOT. I have documentation and lots of proof but Ebay still saying there is nothing they can do, most recently the scammer seller sent me a message that the original tracking number was incorrect and the new delivery date is after I opened a case, which to me should be proof this flatware set never was delivered to me, I am disabled and dont have $300 to pay for something i never received. I do not know what to do, I used Klarna because thats how I can afford to buy such an expensive item.

You do not need to know the address where the package was sent; you just need something official that says it was not sent to the address in your order details.
Shipping services will not reveal private information if you are not the sender or the recipient, but no private information is revealed by a note on letterhead that says that the tracking does not match your address.

You need to obtain from the delivery service a letter stating that the address to which it was delivered was not yours.

That info may be sufficient to get a refund, but not in an "item not received" case; such cases are handled by bots and you will automatically lose if the seller provides tracking that shows delivery.
Contact eBay via social media if you want help with "false tracking" and use those exact words. You should be given an opportunity to share your documentation with a human rather than a bot in that case, if you want to go that route.

OP11 months agoI did contact them via social media, using false tracking and since this has started I have been only dealing with people, I still get the same reply. Item was delivered, nothing we can do. But all they use to verify delivery is the zip code.
I have no documentation, except the tracking number that shows the bogus dimensions and weight and who signed for it.

It is my understanding that you should be able to get a letter from that service stating that the delivery address was not yours. Sounds a lot like that delivery address scam to me.

·11 months agoI AM CURRENTLY IN THE SAME SITUATION, BUT THE ONLY DIFFERENCE IS I HAVE PROOF, I HAVE PRINTOUTS SHOWING IT WAS NOT DELIVERED TO MY ADDRESS BUT A TOTALLY DIFFERENT ONE, EBAY TOLD ME IT CANT HELP ME BECAUSE ITS THIRD PARTY, WHAT ? **bleep** DOES THAT MEAN, ALSO, AFTER I MESSAGED THE SELLER (SCAMMER) FOR THE UMTEENTH TIME, AND I SHOWED HIM MY PROOF IN THE MESSAGE, NEXT MESSAGE I GET FROM THEM IS THERE WAS AN TRACKING NUMBER ERROR THE NEW TRACKING NUMBER SHOWS DELIVERY WAS MADE 2 WEEKS AGO, ALMOST A MONTH TO THE DAY OF WHEN I INITIALLY FILED A CASE. TOTAL FRAUD, EBAY IS PISSING ME OFF I HAVE BEEN WITH THEM OVER 20 YEARS.

If the seller is scamming one buyer they are scamming all their buyers. The last thing they want to do is fight with ebay.
