eBay not responding to fraud complaint
I won an expensive sweater at auction on March 15. Total cost charged to my credit card was $416. The Seller hadn’t shipped the sweater for three days, so I wrote and asked his plans. He told me he was readying a number of items for shipment, and that I could expect to receive the sweater within a week. On that same day, he obtained a tracking number for the sweater. Four days later, the sweater had still not been delivered to the USPS. I wrote the Seller again and did not hear back. The next day, I opened a case indicating that I wanted the sweater that I had bought and paid for - not a refund.
Later that same day, I went to the Seller’s site and saw that he was re-selling the sweater that I had bought. I immediately made a fraud complaint.
Now, three days later the Seller has still not responded. More troubling still is that the Seller is continuing to sell expensive sweaters to unwary buyers like me.
By temperament, I’m tempted to leave the Seller a review to warn other potential buyers that this guy is a dishonest scam artist. I’m controlling myself, though, because I don’t want to do anything that will **bleep** eBay off and make it harder for me to recover the $417 I paid.
It is so disappointing to me as an eBay buyer that eBay is allowing this guy to continue to scam people. Any advice as to how to proceed now?

·3 years agoI don't see people being negative, they are suggesting what to do. Every listing shows handling time which could be anywhere from same day up to 30 days. Once you buy, you should see a receive by date. If you don't receive by that date, as said above, next day open a not received case. There is no need to contact the seller or eBay, it is all automated.

He told you to expect delivery in a week.
The seller could ship it 5 days later and you could still get it 2 days after that and that would be within the week they told you that you would get it. You opened a case on the 5th day, the day they were probably going to drop it in the mail.
On a not received case you get your money back. No seller is going to mail it once you opened a case. That could mean you get a refund and the sweater.
I don't see this as fraud because I don't think late shipping is fraud.
I think it's fraud to have it timed so the buyer gets a refund and the item.
If the seller said to wait a week you should have waited a week to see if it would be there or if you didn't agree to wait you should have told them you weren't waiting and went ahead and filed.

OP3 years agoI know my initial post was long, and maybe those who are responding did not make their way through it.
So, to recap three highlights:
1. When I first wrote this seller on March 18, he responded that same day by (a) obtaining a tracking number and (b) writing me that he was “[p]reaping all the parcels right now, will ship em all out priority on Monday [which was March 20], you should receive it within the week.â€
2. Since he obtained a tracking number six days ago, there has been no movement of the item.
3. I wrote him twice on March 22 and he has not responded to me. I opened a did not receive case that same day.
4. He is selling the sweater that I bought from him before, this time with both an auction and an expensive Buy it Now option.

·3 years agoSave the feedback for later. Wait for the sweater or the refund. In the meantime, while you wait, why don't you read about the Ebay money back guarantee so you will know what to do if a future seller tries to pull a fast one. Opening up a case is how you get a refund and not by contacting ebay. They will tell you to open a case.
If in the end, ebay does refund you, word the negative carefully so that ebay does NOT remove it. Do NOT mention ebay or refund in the negative review or ebay will remove it if the seller requests it. Just write, " I paid and the seller did NOT ship. Avoid this bad seller." That is it. That comment is not removable.
I see that warning on a feedback , I keep on searching.

·3 years agoOpen an item NOT received case. Follow the prompts. Completely ignore any emails that the seller will send you. At this point, your seller is a liar so do not waste your time reading his emails. After a date see if there is a tracking # and is it showing movement towards your home? If no, you go back to the case and ESCALATE IT or click ASK EBAY TO HELP. This will force a refund from the seller. Do NOT close the case no matter what the seller says or promises.
If the sweater shows movement towards your home, do not do anything. Wait until the package arrives, inspect it and then come here if the sweater is garbage. Do NOT close the case.

How do I elevate a case, please? I was under the impression that I have to wait for 8 days from the date I opened the case and in the meanwhile I’m supposed to be waiting for an obvious liar and scam artist to resolve the issue. Fat chance. In the meanwhile, he’s scamming other buyers in the same way.

If you just opened the case on the 22nd, return t it on the 26th and escalate.

·3 years agoI'd not leave feedback yet. Open the Item Not Received claim (at least) one day past the Estimated Delivery Date on the order. You'll either receive the item or get a full refund... make yourself whole. Good luck.

I've never seen that verbiage... but it's been years since I opened an INR, so I don't question that you know the semantics. Consider me properly updated.

·3 years agoReads same to me, that they messaged the seller, not that they opened an actual case. It was not till their last post that it was said that they did open an actual case.
An item not received case does not mean you still want it, it is a request for refund for item not received.

As I said in my last post, it was not till your last post that you actually said what case you opened.
There is no case to open for what you were asking for through eBay in your first post. Once an item not received case is opened, the seller has 5 days to refund. If they have not refunded in the 5 days, you can ask eBay to step in and force a refund from them.
No one can force a seller to ship, not even eBay.
Guess if you want to see posts being hecked, that is your choice, but anyone can post on the chats even if you don't like the information or how someone read the post.

The sweater was originally supposed to be received by March 20. Then March 22. The Seller created a tracking number on March 18 and has not delivered the item to the USPS. Nor has he responded to any of my messages for the last four days.
What particular axe do you want to grind?

First off, the estimated delivery date does not change mid-transaction. If the last estimated delivery date seen when you made your purchase was March 20th, that's the date. Since your purchase is now four days overdue, why not open an item not received case?
Have you read eBay's Money Back Guarantee for buyers?

·3 years agoYour 1st somewhat detailed post failed to provide "dates". That likely generated the response garnered.
If you were to buy from me on the 15th eBay may show you the 20th-21st, but because of my stated handling time I would not even be required to ship until the 22nd.
